WORCESTER, MA He didnt get the $1 million in punitive damages he was seeking, but inmate David Jackson was awarded $3.07 plus interest of 43 cents yesterday after convincing a judge he was sold a pair of defective shower shoes two years ago in the prison canteen.
Mr. Jackson, who is serving time at the state prison in Walpole, contended in a civil lawsuit that the deluxe shower shoes he bought from Keefe Commissary Network were anything but, and fell apart when they got wet. The sides of the plastic flip-flops he purchased for $3.07 on June 15, 2005, became detached after just 10 to 12 showers, according to the suit Mr. Jackson filed last year in Worcester Superior Court.
Acting as his own lawyer, Mr. Jackson maintained in the lawsuit that his civil rights were violated and that he was a victim of fraud and deceit. Through its lawyer, Michael R. Christy, Keefe Commissary said there was nothing wrong with the shower shoes when Mr. Jackson bought them. The company refused to bow to Mr. Jacksons demands for reimbursement.
