True, we are not to judge a man’s heart, only God can do that. But we can judge behavior, as long as it is done righteously.

This sounds like a lawyer quibbling with the spirit of what Jesus taught. He chastised those who were judgemental for being hypocrites on the face of it. Keep looking for the "technicality" that allows you to do what you want, but you aren't doing what Jesus taught.
