You don't understand. It's OK to hire someone because of their race -- you just can't fire them because of their race.
But your comment does make an excellent point. If an employer has two equally qualified candidates -- one white, one non-white -- this type of legal action provides the employer with the incentive to hire the white. The white guy can easily be fired for non-performance.
Hire anyone else -- black, Hispanic, female, gay, disabled, obese, etc. -- you're hiring for life.
