White House Sends More Judges to the Senate

NOMINATIONS SENT TO THE SENATE:

Robert J. Conrad, Jr., of North Carolina, to be United States Circuit Judge for the Fourth Circuit, vice James Dickson Phillips, Jr., retired.

Catharina Haynes, of Texas, to be United States Circuit Judge for the Fifth Circuit, vice Harold R. DeMoss, Jr., retired.

Sean R. Mulvaney, of Illinois, to be an Assistant Administrator of the United States Agency for International Development, vice John Marshall, resigned.

Shalom D. Stone, of New Jersey, to be United States Circuit Judge for the Third Circuit, vice Samuel A. Alito, Jr., elevated.

John Daniel Tinder, of Indiana, to be United States Circuit Judge for the Seventh Circuit, vice Daniel A. Manion, retiring.

That’s a lot of vices. I suppose “vice” means “to replace”, but it’s not in my dictionary that way.

I have a feeling that this is sending a couple of signals.

1. The Senate should get to work and forget about the PJ parties.

2. Go ahead and forget about all the important work like the budget and go on recess, then I will make my appointments.

So, looks like “VICE” used in this manner (a preposition) means “in the place of”.

Chances are, a few will be uncontroversial and be approved without fuss. But others (particularly if they’re replaing a liberal) will draw the Rodents’ fire.

Shalom Stone is probably dead on arrival. The NJ Senators are already releasing the typical ‘waaaaaah, no consulting’ comments.

Haynes and Tinker are probably good to go. Conrad, the most important of the 4, is a tossup.

The 4th circuit is in terrible shape, as the once ‘most conservative’ circuit has 5 out of 15 seats vacant. It has jurisdiction over the Guantanemo cases. With Senate GOPers squabbling and being useless (Lindsey Graham), Hillary will shift this court drastically if she gets the chance to fill all 5.

I wonder what makes the President decide to appoint these people out of session instead of making them go through the full process?
Also wonder how many he has had to send up that way?

Judge Tinder taught my trial practice class section (4 people) in Law School. After our mock jury trial he invited us over to his house for a few beers while he critiqued our performance on videotae. Strong conservative and a great nomination.
