Can’t say I disagree with Wal-Mart banning her, however, I just wonder if it’s legal to do that before she has had her day in court? If she’s found guilty, that’s one thing. But if she’s found not guilty, could she legally be kept out of a store which is open to the public? Just a thought.

As a cultural note, I see that a disproportionate number of adult, professional shoplifters are African-American women.
I’m not sure why.
However, my wife used to work in retail, and she noted that this made ever black female come under intense suspicion, and that situation was uncomfortable for both shoppers and staff.

I don’t see a problem with WM banning her. Yes, it is open to the public, but it is still private property. It’s no different than Joe’s Tavern banning someone who causes a disturbance after having too much to drink.

Tresspass warrants are almost always issued at the time of arrest and they do not depend on a conviction or guilty/no contest plea. They are usually store specific as well. I've never really heard of someone challenging a tresspass warrant that was issued over shoplifting, but I suppose there could be some instances.
