What is your opinion of Simmions v. State ?

This opinion was directly after there retention, do you feel that the decision was more based on the Simmions case than the constitutionality of Section 847.0138 F.S. ?

Did the Florida Supreme Court uphold the conviction? If so I would almost be surprised they could not rationalize a way to defend the pedophile.

Court got it right in what was basically a no-brainer decision dealing with frivolous constitutional arguments.

I haven’t read through it completely, but it seems like the court looked real hard to find a reason to overturn, but just could not do it.

Of course he was guilty, for what I understand he was a law enforcement officer, what I mean is the opinion concerning the constitutionality of Section 847.0138;
