If one kills someone in the commission of a misdemeanor, then it is a felony. I don’t understand why drivers without insurance or a license are treated any differently by the law. If it were it would stop a lot of illegals and drunks from getting on the road because if something happens, they will not get off and be severely punished. As it is, they get off with a slap of the wrist...even if someone is killed.

I don’t think the felony umbrella has been stretched to include manslaughter in the case of a death during the MD. There also is that tricky little intent thing. I would sue the guy in civil court and take what little he probably has.
