KUALA LUMPUR, Malaysia An ethnic Indian Malaysian was sentenced to whipping and 10 months in prison for hiring six illegal immigrants, the first time an employer has been ordered to face the cane for the offense, officials said Friday.
S. Varatheraaj V. Santrian was sentenced to one stroke of the cane after a court in southern Malaysia found him guilty Thursday of employing six illegal Indian workers at his restaurant in 2005, said immigration department prosecutor Azlan Abdul Latiff.
"This is the first case where an employer is being sentenced to caning," he told The Associated Press. "I think that after this, Malaysian employers will be afraid to take in foreign workers (without work permits). They will think twice."
Malaysia relies heavily on foreign laborers for menial work, employing some 1.8 million registered foreign workers from various countries.
Immigration enforcement director Ishak Mohamed said he hoped the courts would impose more such stiff penalties on not only illegal immigrants but also those who cooperate with them.
"The issue of illegals cannot be stopped unless the employer, agent and those who harbor the illegals are also being caned," he told the AP.
"The answer is continuous enforcement, day and night, week to month," he said.
Ishak said authorities were intensifying the crackdown on illegal immigrants, who are estimated to number 500,000 to 700,000. The number includes some 150,000 refugees and asylum seekers, activists say.
Most illegal immigrants work in construction industry, plantations, restaurants and other low-paying, labor-intensive jobs that most Malaysians shun.
Ishak said that in the first seven months of the year, some 30,000 people had been detained, and 10,000 of them had been charged. Illegal immigrants also face caning before being deported.
Varatheraaj's lawyer, Azrul Zulkifli Stork, said his client won't be caned or imprisoned until his appeal to the High Court has been heard. He declined to comment further.

HMMMM. Caning. Not a bad idea. LOL. I can see it now. Agricultural company employers, construction company employers, sub contractors of EVERY field in the U.S., service industry employers lining up in a line that runs from NY and back to NY around the world three times to get their caning. The questions is not is it too cruel. The questions is how many swipes. IMHO.
Swap the caining with something more American in nature, like breaking rocks, and this is about right.
The government will work its way through the Indians and Chinese and that's all you'll hear about it.
A bit of fantasy--down the road from my home is a burgeoning lake resort, which requires an army of illegals to build and maintain. As a result, the local schools have gone from 5% ESL to 15% ESL in five years. (This is an excellent way to track illegals, paying attn to ESL rates in the schools.) Tripling in five years...
My friends have started to find themselves in car accidents where the at-fault driver flees and there's no insurance...the local DUI arrests are going up...the small town has three "Western Union" money-laundering services fronting as stores...but the windows are covered in notices and if you're on the sidewalk you can't see inside...
Oh, just to see the rich folk don orange jumpsuits and pick up trash along the Blue Ridge Parkway...I'd settle for that, without the whipping...
Harsh Punishment for Employing Illegals
The punishment doesn’t seem to be harsh for such a crime.
maybe the people who employed the messicans who stangled the 15 year old girl this week should be caned? But hey, if we don’t enforce border laws, maybe they thought rape and murder was another law we didn’t enforce? And even if we did enforce, they could just blend in and get another SSN? Thank God for DNA evidence.
