If that hard drive has been transferred between several people and those images were found in a cache or tmp file, and that’s all they had on him, I’d vote to acquit.

It should be pretty easy to determine. Every file is date stamped when it is saved onto a computer and every time it is viewed. It is a simple matter to establish a timeline in most cases.
