On This Day in History: August 17 - Lynching of an Innocent

MARIETTA, GA — Leo Frank was born in 1884 in Cuero, Texas, but before he was a year old his parents moved to Brooklyn. He attended Brooklyn public schools and Pratt Institute and graduated from Cornell with a degree in mechanical engineering. Frank’s uncle, Sigmund Montag, owned the National Pencil factory in Atlanta. In 1907 Frank moved there to manage the business. Lucille Selig, daughter of a prominent Atlanta family of German Jews, became his bride in 1911. Frank was elected president of the Atlanta B’Nai Brith lodge.

The pencil factory, like many other industries at the time, used child labor. One of them was a 13-year-old girl named Mary Phagan who had been laid off at Frank’s pencil factory. She was owed $1.20 in wages (12 cents an hour) that she had earned putting eraser caps on pencils. There was to be a big parade in Atlanta on April 26, 1913, to celebrate Confederate Memorial Day. After traveling from her home in suburban Marietta, Mary went to the dark, nearly deserted pencil factory to pick up her pay, but she never made it to the parade on Peachtree Street.

Mary’s battered body was found in the basement of the factory. Her bloomers were ripped and bloody. Her pay was not in her purse. Leo Frank was charged with the murder because he was the last person to admit seeing the girl alive, and his nervousness was seen as a sign of guilt. Thirteen days after the crime, Frank was arrested and charged with murder.

I remember seeing the tv movie about this with Jack Lemmon years ago. A very good movie I thought.

“Eventually, Frank was vindicated. In 1982, Alonzo Mann, by then an old man, came forth with the information that he had seen Jim Conley dragging Mary Phagan’s body. Mann, then a thirteen-year-old office boy at the pencil factory, was told by Conley not to tell what he had seen, or Conley would kill him. Alonzo Mann swore in an affidavit. Mann died in 1985.”

YEAH. Well, it’s not all that clear that the guy was innocent. At this remove, it’s very hard to say. Witnesses who come forward decades after an event are not all that credible or reliable. That said, he shouldn’t have been lynched.

I think he was making reference to Jim Conley whom Mann in 1982 identified as the killer.

Alonso Mann was a 14 yr old boy at the time and Mr Frank was accused at trial of performing oral sex on the boy.
