New Orleans (AP) -- A federal appeals court ruled Wednesday that Louisiana's attorney general can't sue the Army Corps of Engineers on behalf of Hurricane Katrina victims who don't have lawyers.
The emergency order by the 5th U.S. Circuit Court of Appeals came on the day of the deadline flood victims had to file suit the second anniversary of Katrina. The order negates a lawsuit filed by state Attorney General Charles Foti earlier Wednesday.
The appeals court said that U.S. District Judge Stanwood Duval acted without proper authority in appointing Foti as guardian for about 350,000 people with claims against the Corps.
Duval had agreed to let Foti sue the Corps on behalf of lawyerless claimants who had not yet filed suit. Plans called for a comparison of the names Foti submitted with the names of flood victims who have lawyers, and for those names to be removed from Foti's list.
Duval had encouraged all people planning to sue to get their own lawyers.
The attorney general's office was working on a reply to the 5th Circuit, said Kris Wartelle, a spokeswoman for Foti.
Joseph Bruno, lead plaintiff attorney, criticized the 5th Circuit's ruling, saying it would likely cut out many people from pursuing action against the corps.
"Every time you turn around, the government is sticking it to us, trying to limit their liability," Bruno said.
Bruno said the deadline to file suit would stand, no matter what legal action was taking place.
"If you haven't filed by the end of today, it's all over," he said.

Apparently at least one federal judge agrees with them. But, from I've seen coming out of federal courts, there is at least one federal judge who will agree with anything.
I sure hope they named the Landrieu family in that lawsuit...

I live in the Pacific Northwest, and I can see the corruption in Louisiana from here. You’d think the state AG would give it a little attention, wouldn’t you?

Divide the amount of my tax dollars that went to this area in 2 years by the number of "refugees", and we could have GIVEN each family OVER $1,000,000 CASH and still save tax dollars currently...if not future dollars.
As much as I love Louisiana, I will always think of it as my home, it is a challenge not to be ashamed about it sometimes.
I know that there has been a LOT of progress made over in Mississippi - I have friends with family in Pass Christian. They haven’t been sitting on their hindquarters over there waiting for somebody to do it for them.
Of course, Mississippi is in great shape compared to N.O. It’s obvious by the fact few are interviewing the ‘oh so sad’ stories 2 yrs later in Mississippi compared to N.O. The difference is like night and day. Can’t allow a red state to out shine a blue state....that glares way to much.
At least you don't have to live around these "victims." I'm in Houston and there are two "temporary" Section 8s (apartments taken over by Katrina Holocaust "victims") just on my way to work. They all have new cars, and just got FEMA extensions all the way to March
And with that, we get the robbing, raping, and murdering. I cannot even begin to tell you my disgust with narcotic welfare, the liberal plantation, and every Democrat who goes to NOLA and panders to these money grubbing, lazy, buffoons!
Had the L.A. governor and mayor declared NOLA a tax free zone for 3-5 years, the place would have been rebuilt YESTERDAY. Instead, they want to FEDERAL GOVERNMENT to rebuild a freakin' slum!
