Could a member of the Bar elucidate on whether even if VaTech knew more of Cho, would FERPA (The Family Educational Rights and Privacy Act of 1974) not have allowed them to act against him ahead of time.

I don’t know. FERPA restrictions are confusing

FERPA gives students the following rights regarding educational records:
The right to access educational records kept by the school;
The right to demand educational records be disclosed only with student consent;
The right to amend educational records;
The right to file complaints against the school for disclosing educational records in violation of FERPA.
Students have a right to know about the purpose, content, and location of information kept as a part of their educational records. They also have a right to expect that information in their educational records will be kept confidential unless they give permission to the school to disclose such information
Records Not Considered As Educational Records
The following items are not considered educational records under FERPA:
Private notes of individual staff or faculty; (NOT kept in student advising folders)
Campus police records;
Medical records;
Statistical data compilations that contain no mention of personally identifiable information about any specific student.
Faculty notes, data compilation, and administrative records kept exclusively by the maker of the records that are not accessible or revealed to anyone else are not considered educational records and, therefore, fall outside of the FERPA disclosure guidelines. However, these records may be protected under other state or federal laws such as the doctor/patient privilege. As an attorney, I recommend that you check to make sure that you fully comply with these disclosure guidelines before disseminating any of this information .
The breakdown appears to have been between the University-run Counseling center on one hand and the University officials and staff on the other. It is lawful for the University officials and staff to report behavioral anomolies to the Counseling Center—whether they did or not is being investigated. Had that report been made, it is incumbent upon the Counseling Center to take appropriate action, including notification of Law Enforcement. FERPA should not have entered into the mix if the aforementioned procedure was followed.

This guy had guns on campus which is against the rules. Nothing was going to stop this guy. Even if we acted on his disability, he could still do the same thing.

Public opinion does not obtain in cases such as this. I’ve run several Mental Health Centers and am quite familiar with the law in cases like this. From what I understand that is not the case for school and other officials. That is, they falsely interpreted the law as being an impediment to sharing of vital information between various agencies and the school.
No way. I am claustrophobic. It’s going to be a mess. Tickets are really hard to find. There will be a lot of counterfeit tickets being sold.
I’ll be at home. I may venture out to the Farmer’s Market if there is parking available but I doubt it.
Yeah, my son is a freshman at a community college here. But his girlfriend is a freshman at Tech. She can’t get a ticket for him either.
The media says Tech have screwed up badly but people are doing everything in their power to get here. Go figure.
Another carbon monoxide leak at an apartment this morning. I don’t think anyone was hurt.
My son wants to transfer there as soon as he can (it’s a long story). I think the April events made him more determined to want to be there.
People were amazed at the response by the students. It really is a nice campus and relatively free on the nutty clingons that infest many campuses. The only drawback is the weather.
And the bad year we had last year
Well, growing up “next door” the weather didn’t bother me too much.
I love my alma matter but still regret only doing part of my education at Tech. I still wish I had a degree from there.
