They should just cross the border to another state, to buy their cigarettes, the same way Kansans tag their vehicles in other states to evade paying personal property tax.

You don’t know what you’re missing, wheee. Cigarettes are the ideal finish to a good drink, or to a good meal. They help you relax when you’re stressed, nervous or depressed. They provide an activity when you’re bored, and something to do besides eat, when you are someone who snacks when bored. They speed up the metabolism, burning more fat-causing calories. They can keep you awake during long drives. They help you to wake up in the morning, and are a fine finish to a long day. They make for a great excuse to take a break at work.
In essence, you know the negative effects of smoking, and like the rest of the sheeple, you assume there can be no benefits.
Do you think that 75% of the adult population smoked cigarettes, at the height of cigarette popularity, for no reason at all?
I have smoked for decades, and intend to smoke for the rest of my life. I know the risks. It’s like any other unhealthy habit, in that you must accept these, if you want to continue doing something you enjoy.
If I could be guaranteed that I could live forever by quitting, I might be more inclined to do so.
Unfortunately, it’s pretty certain that some day I’m going to die.
Why give up what you love, in exchange for a chance at having a few more years?
I may change my mind later, if my health becomes more certainly threatened by smoking, say, if I get emphysema.
But for now... either make it illegal, or get off my back.
Because they are addicts they are exempt from collection actions.
I believe it is part of their constitutional right to smoke.

He might have a good case. The sales tax law in many States specifically says that sellers have to collect the sales tax from consumers, which the State then collects from the sellers. The law cannot state that the State can collect the tax from “whoever” they can tax in a transaction.
And if the court rules that the State can collect the tax from consumers, then sellers are no longer under any obligation to collect the tax themselves, as long as they file a record of the taxation for the sale with the State. Let the State then send out bills to all consumers for every transaction that they make.
But the State cannot have it both ways.

On a more logical note, I don't know what the purpose of sending in the guys death certificate was, nor for including it in the story. It's totally irrelevant.
I wish these stupid states that put such an effort to collect tobacco taxes would put the same effort to collect income taxes from illegal aliens.

No there isn't near enough said. How convenient that one of the 500 died of lung cancer, makes for great propaganda. But let's think about this for a moment. Why would the man's estate send in a copy of his death certificate? His estate would still be liable for the past due taxes. Unless of course the state taxed him for purchases made after his death. Also why the anonymity; why is he not named so that this bit of info can be verified?
When a bit of propaganda is too good to be true, it most likely is untrue. If it isn't verified, don't believe it. Mr Ewald did not say near enough to make this believable or verifiable, but since it makes for such good print, no one is ever going to question it.
