If you’re incapable of coming up with any argument on the merits, or perhaps even of understanding the question, then it’s always wise to critique your opponent’s motivation, isn’t it? Even if I were a paid shill for the administration (or the trustees, but they’re probably the same to you), how would that change the fact that there never was a contract? You have not read the 1891 resolution that some people call the “1891 Agreement,” have you? It’s an ephemeral corporate policy that gives the alumni permission to nominate five people for the board to elect.
Good thing most alumni have more sense, and more rhetorical skill, and voted to withdraw the lawsuit. That is assuming you are an alumnus.
A brief update: since that article appeared, the entire Association of Alumni leadership has termed out of office and not been reelected, the Association has withdrawn the lawsuit, and the Board has elected five alumni as new charter trustees.
