Teens' lives in legal tangle in Fountain Valley

Athlete convicted of lewd conduct told to attend different school after girls' parents complain. But the teen's mother says she'll fight to get him into Fountain Valley High ___ FOUNTAIN VALLEY – The girls wanted to start their first day of high school today without the dread of bumping into the 14-year-old who was convicted of lewd conduct against them.

Their parents lobbied the school district to remove the teen from the high school, saying their daughters deserve the right to a fear-free education.

The teen, a promising football player, wants to attend the school because it has one of the top football programs in the county. His mother tried but failed to get the court to modify a restraining order that keeps him at least 100 yards away from six girls. She said her son has served his debt to society and deserves the right to move on and pursue his dreams.

I’d like to know what exactly this guy was convicted of before making any judgement. It’s not made at all clear in the article. “Lewd conduct” can mean a lot of things, especially in this context. And, given the relative ages and proximity of the people involved (from the way the article reads, they’re all High School Freshmen), it’s hard not to come to the conclusion that this whole thing started with some parents turning some foolishness into a Federal case.

Well, I thought the same thing but one of the charges was a felony so, that sheds a different light on the matter. You don’t get a felony for “flashing” or running across the football field nude, for example. There had to be something pretty serious here.

Oh, I assumed that he had sex with the girls in question and then pled out. But, given that we’re seemingly talking about fourteen year-olds with other fourteen year-olds, I don’t think that it’s really a matter for the courts - it’s a matter for parents.

My assumptuon, and perhaps it’s flawed (but, I don’t really think so) is that if there was any allegation of force or anything more serious, that would have been mentioned.

From a news article:

The teen’s mother said a judge issued the restraining order against
her son before finding him guilty last summer of one felony count and
five misdemeanor counts of lewd conduct. The judge sentenced him to 30
days in juvenile hall, she said.

“He wasn’t allowed to speak and have his side heard,” she said of the
court proceedings. “We haven’t even heard his side.”

The teen’s mother said that her son, like many teenagers, is not
without fault.

She said some of the allegations aren’t true, while others are. She
declined to elaborate.

I don’t think that’s obvious at all. Indeed, I have a very hard time believing that prosecutors would let someone pled down to thirty days in juvie for a non-consensual act. That, I daresay, would be an outrage.
