Corrie v. Caterpillar DISMISSED by 9th Circuit
9th Circuit Ct. ^
| Sept. 17, 2007
Posted on 09/17/2007 10:50:58 AM PDT by Alouette
WARDLAW, Circuit Judge:
Plaintiffs Cynthia and Craig Corrie, Mahmoud Al Shobi, Fathiya Muhammad Sulayman Fayed, Fayez Ali Mohammed Abu Hussein, Majeda Radwan Abu Hussein, and Eida Ibrahim Suleiman Khalafallah filed this action after their family members were killed or injured when the Israeli Defense Forces (IDF) demolished homes in the Palestinian Territories using bulldozers manufactured by Caterpillar, Inc., a United States corporation. The IDF ordered the bulldozers directly from Caterpillar, but the United States government paid for them.
The district court dismissed the action under Federal Rule of Civil Procedure 12(b)(6), finding it lacked jurisdiction because, inter alia, the political question doctrine precludes decision by an Article III court.

Terrorists that have the support of their families to wipe out random folks innocently deserve to have their family homes crushed afterwards.
Rachel Corrie had sympathy for the terrorists and the Intifada of Yasser Arafat.

It is a sad reflection on the US justice system that such a patently meritless suit ever made it to a federal circuit court.

Didn’t just make it, but was argued for the plaintiffs by Chemerinsky, a very well known liberal con law scholar who will be a canidate for a sea on the Court if the Dems get control of the nomination process.

The plaintiffs feel crushed.
I suspect that's an inadequate description for the "shock and awe" they experienced
in an American courtroom...and even made more bitter when it
was the NUTBURGER Ninth Circuit.
The plaintiffs were probably convinced by the adoration from
the ACLU/Code-Pink/"Freedom-Fighter" echo-chamber they've lived in...
that this sort of judicial defeat just couldn't be found in a
fevered liberal swamp like The Ninth Circuit.
I don't care if the decision was strictly made "on the law" or if
some liberal Jewish judge had an epihany (Hey, I can't let terrorists
enrich themselves!) or a closeted evangelical Christian, or even
an lucid atheist/agnostic woke up and decided that letting terrorists
earn $$$ is "just wrong".
Whatever the REAL origins of the decision....it works for me
at this juncture.
