N.Y. Unveils Plan to Give Illegal Immigrants Drivers' Licenses

New York State officials say a plan to provide driver's licenses to illegal immigrants with valid foreign passports will enhance security by creating records of their identities. But critics say those records could compromise security instead. Advertisement

New York has between 500,000 and 1 million undocumented immigrants, many of whom drive without licenses and car insurance or with fake licenses, Gov. Eliot Spitzer said in announcing the plan Friday. He said it would bring "people out of the shadows'' into American society.

"They no longer need to hide and pretend they are not here,'' Spitzer said. "We will not become part of what is propagated on the federal level -- that if we don't admit they are here, then we can somehow not provide services. That is bad policy.''

The shift in policy is geared toward increasing security and reducting insurance premiums for all New York drivers by an anticipated total of $120 million a year, said state Motor Vehicles Commissioner David Swarts.

Under the new policy, immigrants -- regardless of their status -- will be permitted to provide a current, verifiable foreign passport in applying for a license. The policy will be phased in, beginning in December.

The change drew the scorn of some Republican lawmakers from New York. Rep. Randy Kuhl, R-N.Y., said the new policy "undermines the preventive measures that protect our country from national security threats.'' The Sept. 11 hijackers had licenses that helped them rent cars and open bank accounts, he noted.

Kuhl also predicted the license policy would encourage people "to flood New York State,'' taxing its social services, schools, and hospitals.

But Michael Balboni, New York's homeland security head, said the new system would improve security because it creates public records that law enforcement agents and others can use to ensure true identities.

"What we are driving towards is the crucial concept in security: One person, one license,'' Balboni said.

Chung-Wha Hong, executive director of the New York Immigration Coalition, called the new policy a victory for immigrants.

She said immigrant New Yorkers who could not get licenses had a difficult time making it to work and getting children to school.

Similar policies have been adopted in Utah, New Mexico and other states.

Current federal law 8USC 1373(a) PROHIBITS SANCTUARY CITIES. It reads as follows:

"Notwithstanding any other provision of federal, state, or local law, a federal, state, or local government entity or official may not prohibit, or in any way restrict any government entity or official from sending to, or receiving from, the Immigration and Naturalization Service information regarding the citizenship or immigration status, lawful or unlawful, of any individual."

I emailed all of our state Reps in Georgia. I recommended that they not recognize NY state licenses. A state rep named Bob smith relayed my message to a Senator named Chip Rogers who sent a return email to me saying.

Thanks for the message. A few years ago we took care of this problem - it was the bill that removed the fingerprint requirement. I added an amendment that said Georgia will not accept any DL from a state which
grants them to Illegal Aliens. I will make sure the DDS knows that NY is now giving the DL to illegal
aliens and it should not be recognized in Georgia pursuant to our law.

Maybe one person (a freeper) really can make a difference! Just to be sure why doesn't everybody email your state Reps and Senators and advise them accordingly. you can get there email address by googling the state Legislature of your state.

Kuhl oughta know. He's an Upstate Critter and Upstate's rapidly becoming a ghost town.

What’s worse is that this issue has barely scraped the presses here in NY (sort of like all those Spitzer probes that are now under the radar). Maybe one day of debate on the local talk radio stations and everyone moving on. As if it is a done deal.

NYS is a toilet forcing the rest of the nation to be flushed as well. Might as well give the cop pulling you over your high school ID, seems it’s just as valid as a driver’s license here.

One wonders why International Drivers' Licenses issued by their country of origin aren't good enough?

Gee, could it be because those won't get them bennies or into a voting booth...?

You don’t know how many times I’ve wished NYC and Long Island would just break off, form thier own state....and save us from the travesties they keep electing to office.

Most of the state, outside of those areas is actualy reasonably conservative. The only thing that saves us from being a complete gulag is the state senate which, just like the U.S. Senate, has representation by district.... they can usualy be relied upon to block 95% percent of the idiocy coming thier way. I’m guess that this drivers license thing doesn’t require any legislation...just an executive order from Fearless Leader Spitzer....otherwise I can’t imagine it getting passed the State Senate.
