It can hardly be considered advertising since the viewers are already customers or prospective customers - they are inside the restaurant. It is not being used as an endorsement or a solicitation.
The letter specifies that it's in the front window.
I've been to the place a few times. He keeps pictures inside the restaurant, some in the front window - but they are behind the flowers - you would have to really be looking for the picture.
There is no way you could just walk past the place and be led to think - hey! Chelsea must eat here! I will too!
