Don’t know what the actual punishment would be, but the answer is “Yes,” if this line of “reasoning” (and I use the term guardedly) is carried to its absurd but logical final conclusion.
His probable line of defense is that, while she could see and hear him, the reverse was not also true. He had no way of knowing for certain that an unrelated female was watching him.
Actually, I have a feeling that there is a lot more to this story than is being told. The incident maybe more like the last straw rather than an isolated first incident.
But, who knows? With these guys’ springs wound so tightly as it is, anything and nothing can set them off.
