A NEW York appeals court has ruled that a landlord can evict Bianca Jagger from her Park Avenue apartment because of her immigration status.

The former wife of Rolling Stone Mick Jagger has lived in the rent-stabilised apartment for 20 years and argued that it was her primary residence and her landlord should be barred from evicting her.

A British citizen who was born in Nicaragua, Jagger is in the United States on a B-2 tourist visa.

Her lawyer Ryan Goldstein had argued that mould in the apartment had made it unliveable and she had stopped paying the $US4614 ($5148) a month rent in 2003.

The landlord, Katz Park Avenue Corporation, said Jagger was in the US on a tourist visa and was not eligible to maintain permanent residence.

The 3-2 decision by New York State Supreme Court's Appellate Division reversed a lower court's finding.

The decision, which noted that the environmental activist also had a luxury apartment in London's Belgravia, said Jagger would also have to pay back rent and other fees.

How can a person not pay rent for 4 years and not be evicted???

Well, there's your problem right there, mate. We don't have mould in this country, only mold. Perhaps the landlord thought she was complaining about the moulding around the doors and windows or something, and that's hardly a reason not to pay rent.

I was listening today to some British reporter on the radio doing a story about the fact that 50 miles of border fence had been built. He called it a white elephant, that most Mexicans came over—I am not kidding this is what he said—as tourists via an airplane and just overstayed their visa.
I wondered if that was how he managed to get in the country. It appears to be how Bianca did it. Bye!

Not to be a jerk (I guess I’ll come off as one anyway), but the article originated from Australia where I imagine they spell mold mould. Much like the British spell color colour.

Very funny! Actually, I suspect Jagger's claim is bogus. We have very little mold (or mould), not enough to withhold rent over anyway, in the northeast US ... unless you have a basement apartment, or an unvented bath. Which I doubt Ms. Jagger's Park Avenue address had.

Btw, landlord/tenant law requires that rent that is withheld by the tenant must be placed in an escrow account, pending resolution of the dispute. Wonder if Jagger obeyed that law?

Nice to know the courts have the final say as to who a private citizen may or may not evict from his own property. When were the black-robes given their feifdoms? Nothing new I suppose...I’ll just go back to buying consumer goods. Sorry I even looked up. baaa... baaa...

Four years to evict someone. Gotta love those liberal states. And, she could argue that she shouldn’t be evicted because it is her permanent home? Is that a real excuse in NY? If that is the case one could never evict a non-paying tenant as most folks only have one home, unlike Bianca.

I will never complain again when a (really long, trial included) eviction takes 6 weeks.
