A physician's assistant first recommended a biopsy in April 2006, noting that Castaneda's mother had died of cancer at age 39.

Castaneda, who left El Salvador with his mother during a civil war, was living in the Los Angeles area when he was convicted of possessing methamphetamine in 2005 and spent eight months in county and state custody, his lawyers said. His immigration case includes a claim of political asylum. He says he would be persecuted and tortured if deported because of his former affiliation with a Los Angeles Salvadoran gang.

I feel sorry that he is going to die but I don't feel responsible for his treatment. I also wonder about this political asylum claim. If deported he faces persecution from being part of a Los Angeles Salvadoran gang...MS13 maybe? I can't see why he should stay here where the gang is. Send him home to die. Next we will be stuck with burying him.

Am I the only one that sees that there is a way to eliminate all these BS suits (as well as many other threats to our culture) by simply clarifying two things?:

1. The U.S. Constitution applies only to Citizens and legal residents.
This should be self-evident, and the mischief done by pretending it applies to the whole world, or to illegals, is demonstrably insane and self-destructive. The logic of this deserves a thread all to itself.

2. Citizenship applies only to children of citizens and resident legal aliens.
Legal alien non-citizens who leave the U.S. for 6 months or more, lose their legal resident rights. Allegiance is a vital component of "American citizenship". We can't continue to tolerate the scamming of our most precious rights.

This, I think, has made a mockery out of our laws, specially the immingration laws.

"Political asylum" can never, under any circumstances, be construed as a "benefit" for criminals as a means to escape justice in their own countries for criminal acts under their laws.

Think about it; if our laws (and protections) should apply to criminals of all countries, why shouldn't French laws, or Ugandan laws or Iranian "law"?
