Evidence against former astronaut tossed

A judge agreed Friday to toss much of the evidence against Nowak, a former astronaut accused of making a diaper-assisted, 1,000-mile drive to confront a woman vying for the affections of the same space shuttle pilot.

Investigators took advantage of 44-year-old Lisa Nowak, who had not slept for more than 24 hours, coercing her into giving information in a lengthy arrest interview, Orange County Circuit Judge Marc L. Lubet said.

Lubet granted a defense motion to throw out comments she made during the six-hour interview and items seized during a search of her BMW, including maps to alleged victim Colleen Shipman's home, large garbage bags, latex gloves and some soiled toddler-sized diapers.

More so, she is military and will face UCMJ justice.

Nowak is at risk of court-martial for conduct unbecoming an officer and a gentleman and adultery, due to her marital infidelity and perhaps attempted murder.

Don't know, but she's certainly getting Pampered treatment!

I said this a couple of months ago, and I will say it again: This woman is not going to get a day of jail time. Her attorney will make her look sympathetic, besides, there was no actual 'kidnapping', as most people think of it. The victim got nailed with pepper spray, and for just about anyone with a clean record, there's a strong chance of mere probation anyway, especially if the perpetrator is female.

But her attorney will pull out the 'astronaut hero' card, and further point out that for the rest of her life, she will have to suffer the label 'diaper astronaut', with all the attendant humiliation. He will argue that she's already suffered enough, given the public flogging, and being drummed out of the astronaut corps with its first 'dishonorable discharge'.

Not one day in jail. Mark my words.

It is always the job of the defense to see that the client gets little or no further punishment.

There's every chance that it was space flight that screwed this woman up. You go up into a zero-g environment your T-cells stop functioning. When you come back down to Earth, they start with a bang.

Sometimes the "restart" is rocky and folks find out they have recessive genes that create "allergies" to all sorts of things.

This woman is not the first astronaut to get seriously ill after a trip. She won't be the last. What I don't understand is why NASA didn't arrange for appropriate medical intervention.

BTW, the obvious onset of Celiac Disease is a clue to the problem.

Clearly, Lubet is corrupt and the fix is in. My guess is that the astronut’s lawyer is a political heavy hitter, and either he throws around a lot of campaign cash to judges or he’s got some dirt on Lubet. Whatever. Obviously the lawyer is “connected” and he is having a wink and nod party with the corrupt judge Lubet.

How do we really know any of the facts if we are not in the courtroom hearing the evidence. I am never one to swallow the prosecutors assertions. These guys have careers and they only look good when they win. Remember Nifong.

Unfortunately life has taught me to distrust virtually everyone involved in a court case, because even when people believe they are telling the truth sometimes they just see a cylinder from end on perspective, and report they see only a disk... She is an astronaut and military pilot.

As far as I know, male pilots have piddle packs.
I am sure they have the equivalent for the female pilots.

Or, am I wrong, and she had a box of diapers in the car?

What I am seeing is solid evidence getting "tossed". Period. Evidence should only be "tossed" if there is a flagrant disregard of Constitutional principles or a possibility that evidence was planted or unreliable in some way. None of that is the case here. In fact it sounds to me like the cop did some pretty good police work. Thanks, Judge. This ruling was a pile of liberal activist penumbra/emanation horse manure.

The fix is in. And possibly the prosecution is in on it.

lets face it.....no harm was actually done....there are convicted child molesters and rapists out on probation by lenient judges...

I think the public gets its jollies over these stupid...although serious...crimes.....

her normal life is over....her space career and her military career...I suspect she will be in major therapy for some time....hope she recovers to realize her mistake....

I’m still wondering how Ms. Nowak drove from Texas to Florida without stopping for gas, even if she avoided stopping for restrooms. That’s a two-day trip.

Probably had one of those Pogue carburetors the gov’t has been surprising for fifty years. NASA’s part of that huge conspiracy. The real reason this ruling — which amounts to a dismissal of charges — got made was because the defendant threatened to reveal information in her possession regarding NASA’s moon landing hoax. ;’)

Well, I'd say that the victim certainly has a civil case, and should be entitled to receive monetary damages, but as to this being a criminal case, we'll have to see how the evidence plays out. Like I said, under the circumstances, any shyster would give his left gonad to be able to get her off, because there's a substantial chance of doing so. Then the ambulance chaser can sell his services for big bucks once he becomes a minor celebrity.

After all if you look at prison populations there are just as many women as men behind bars.

Check the execution statistics, no gender gap either.

Child custody? Equal between dads and moms, as are child support payments and alimony.

You really need to check you facts before making such outrageous statements...
