Joanie, this is a travesty. This is a demonstration of how such corruption and lust for power and control at all costs, how a willingness to crush the legal system, using it against itself, reaches further and further down into society.

No honest judge should have ever entertained such a motion. This is, as you say, blatant, out in the open, THEFT, and felony theft at that, under the guise and color of law.

I will be writing each of those envolved and listed in your email and urge all on this ping list to do the same.

I know these theives are pointing to a "law" that would allow them to accomplish this...but it is a law that is being wrested and corrupted to these people's gain, and for that reason, alone, and an honest judge should not even have considered it IMHO.

Interesting.

The corruption of politicians and judges is something that people have to learn to live with. Obviously these two scumbags, Richard McLean and Edith Stevens, have absolutely no fear of the Kirlins. And if the Kirlins are unable or unwilling to “think outside the box”, then they will continue to tilt at windmills and they will ultimately lose their land.

I guarantee you, there are plenty of people in this country who McLean and Stevens wouldn’t dream of trying to rob through the legal system. And the courts and judges and lawyers and cops have nothing to do with it.

This was posted before as a news piece. There’s nothing political, or elitist about this. The Kirlins failed to protect their land for over 20 years and let the neighbors use it w/o protest and w/o even noting what went on there. It’s a case of adverse possession pure and simple.

This should should be news until the land is returned to it’s rightful owners. We as Americans should never tolerate this. Imagine a judge and a lawyer who are suppose to be in noble professions are acting like a bunch of scum.

I personally don’t care if there is a law on the books. The scum clearly took advantage and stole property from a law abiding couple who showed every indication of doing something with their property.

I hate to say it but the judge and lawyer have a case. This law also applies in Texas, and if you don't maintain your property and someone next to yours does it for you, they can make the same kind of claim.

Your land, use it or lose it.

eminent domain is a part of our history. how would highways, railways, dams, etc. be built without it? as long as a “fair” market price is paid, we have recognized in our history a need for such a practice.

It's not the system that's corrupt, it's the people running the system who are corrupt, thus the dictum of eternal vigilance being the price of liberty.

It will be interesting to see how the citizens of Boulder react in the next local elections.

Thus, as is becoming increasingly common in Amerika 2007, ... people in power have decided to use a corrupt system to steal from someone else of lesser political stature -- in this case, out in the open, and without conscience or remorse.

Thank you for this essay, Joanie, I see it as one more brick in the road to revolution.

In truth, my own feeling is that the US has been on that road since the Supreme Court ruled that Corporations have the same Rights as A Man before the Bar of Justice. That single ruling, and the judicial policy of stare decisis has allowed for the socialist undermining of our Constitution and the Bill of Rights.

Corporations, of necessity, are socialist in construct; they have a dictatorial hierarchy without which they could not function. Unfortunately by their standing the corporations are usurping the laws that granted them Powers, not Rights, as We, the People, granted Powers to our Governments.

Kelo was a wake-up call to the Joe and Jill Sixpack Nation, but because of the bread-and-circus lifestyle made obsequious by life's necessities, was one of very few rulings that showed the power that those we have granted Powers to have amassed to our detriment. Our Citizenship has been steadily undermined with lesser rulings, many counter to the true meaning and clear proscriptions of the Constitution, that we no longer live in the land that our Forefathers bequeathed us. I believe it was Ben Franklin who remarked: "A Republic, if you can keep it."

It appears that we no longer have the means or will to regain our true Republic, and I fear for the coming storm that will drive our children back into serfdom.
