Nigeria: Trial For Loitering - American 'Wrongly Deported' Knows Fate, Wednesday[Deported 2 Nigeria]

A Lagos Magistrate Court, Ebute-Metta, Lagos has fixed Wednesday for ruling in the case brought against a black American Mr. Grayson Ernest Eugene who was serving a jail term in the United States before his alleged deportation to Nigeria in error by the American government on December 12, 2006. Eugene, 44, is standing trial before Magistrate R.O. Davis on a one-count charge of "an act not warranted by law" which "causes inconvenience or damage to the public by loitering around American Embassy premises."

Counsel to the accused person from Sola Adabonyan & Co, Mrs Cordelia Chigozie Anyanwu, told the court at the resumed hearing Friday that the accused person, being an American citizen on wrongful deportation to Nigeria, a country where he has no relative and has never visited all his life, had no where else to go than the American Embassy, having found himself in Nigeria for no fault of his. She argued that the American Embassy, or any other embassy for that matter, being the property of citizens of that country, was the only place her client, like any other sensible person, should have gone to in the circumstance.

She submitted that the accused person was not criminally liable as he is a victim of circumstances, stressing that it is shocking and pathetic for her client to be uprooted from the only home he knows just because of the colour of his skin, which he has no control over and that the accused person was acting on the belief that he had every right to be at the American Embassy as an American citizen in accordance with the American Constitution, 14th Amendment Section 1.

The counsel told the court that her client had given his social security number, asking what stopped the American Embassy, with all their sophistication, from cross-checking the information provided by her client, adding that the injustices of her client's deportation to a country he has never lived was compounded by the refusal of the American Embassy to take his finger prints and do a DNA test as the accused person had requested.

Anyanwu urged the court to discharge and acquit her client as there was nothing in the charge to suggest he visited the American Embassy with intent to commit any crime nor did the charge suggest her client was a threat, telling the court that the embassy officials told his client to produce a third party confirmation where he did not know anybody.

She reminded the court that the complainant in the case, the American Embassy, had never been to court and therefore have shown no interest in the case. The accused person had, while giving evidence last Wednesday, told the court that he was born on September 3, 1963 in Greenville, South Carolina to Mr Grayson and Ms Sylvia Atkins, adding that he is not a Nigerian and had only heard of Nigeria in current affairs where he lived at Brooklyn, New York City, which he described as a community of African blacks.

Crazy!! I have know idea if this guy is lying or not. But here is a follow up.

This is one of the craziest things I have ever heard. But, it all depends on the guys story. Amazing.

Public Nuisance - Court Frees American Deportee

Lagos, Nov 23, 2007 (Daily Trust/All Africa Global Media via COMTEX) -- An Ebute-Metta Magistrate's Court has discharged and acquitted an American citizen, Grayson Ernest Eugene, who was arraigned on a one-count charge of constituting public nuisance in the premises of the US Embassy in Lagos.

Grayson, who claims to have been mistakenly deported to Nigeria from the USA, was alleged to have constituted a public nuisance at the US Embassy in Ikoyi while trying to get the attention of the Consul-General.

During the trial, Grayson told the court that he was born in South Carolina, USA, and had been serving an eight-year prison sentence after he was convicted in a credit card fraud trial.

He had been mistakenly picked up by the US security as an illegal immigrant. He also told the court that efforts by him to explain to the US security that he was a citizen by birth proved abortive as they insisted that he was a Nigerian, and subsequently deported him.

On arriving Nigeria, Grayson told the court that he decided to approach the US Embassy to explain his plight, since he knew nobody in the country and had never been to Nigeria.

He said that it was on one of such visits to the US Embassy that he was arrested for constituting public nuisance and taken to Ikoyi Prisons where he had been remanded for the past two months.

He was subsequently charged to court on a one-count charge of constituting public nuisance, an offence to which he pleaded not guilty.

Initially, he was granted bail by the presiding magistrate, Mr. R.O Davies, but since there was nobody to stand surety for him, he remained in prison custody.

There was however a dramatic twist in the matter at the hearing Wednesday as the magistrate, Mr. R.O. Davies, after considering the evidence against Grayson, discharged and acquitted him.

In his judgment, the judge held that the prosecution was not able to prove the allegation against Mr. Grayson beyond reasonable doubt. He ruled that Grayson should be released to an NGO, which had earlier made its intention known to the prison authorities that they would be willing to accommodate him until he resolved his problem with the Embassy. http://www.macroworldinvestor.com/m/m.w?lp=GetStory&id=281745641

What does his birth certificate say and why is there no disclosure as to what city he claims to have been born in?

I’ll bet the guy traveled to Nigeria to collect his $10 million through an e-mail scam and is now stuck there. The Embassy only loans money for citizens who can’t get back home and is not obligated to even do that.

I wonder if "Mr. Grayson" realizes that claiming to know his father's name undermines his credibility.

“He explained that it was his right to speak English with a Nigerian accent and didn’t prove that he hadn’t been born in the US like he claimed.” </BS

I am not buying this idiocy. I suspect he is a con man which his conviction for credit card fraud pretty much confirms.

I swear to you all. I am the real and only Ernest Eugene Grayson. This guy here is a fraud who tried to steal my identity and was tried in a Pennsylvania Court House where my mom and I attended as a witness to my real identity that was stolen by this Nigerian Con Artist Crook,He stole my drivers license, birth certificate and used my name to gain access to my bank accounts. Ask him what hospital in Greenville South Carolina he was born in? He cannot tell you that because only my mom and I would know this.I was born September 3rd,1963. Ask him what elementary school he attended and in what state? Only I can tell you that.Finally ask him if he was born in 1963? Then why is his age 44 and not the correct age which I am is 52.That guy is a criminal and not to trust any words that comes out of his mouth.
