Ten years ago Representative Jim McDermott (D-WA7), known in more recent years as Baghdad Jim for his unqualified support of that city's former tyrant, was serving on the House Ethics Committee. Two Democratic Party activists, who had illegally recorded a telephone conversation between Representative John Boehner and then-House Speaker Newt Gingrich, delivered the hot tape to McDermott.

McDermott made a the first of a series of truly bad choices. Rather than pursuing his passion for Gingrich through the channels of the Ethics Committee, he delivered the tape to a reporter in what the trial judge ruled was a malicious attempt to politically harm his colleagues through an invasion of their privacy.

Rep. Boehner offered to settle the case years ago for $10,000 and an apology. McDermott, caught up in what might in later years be called Gingrich Derangement Syndrome, refused.

Today's decision by the Supreme Court not to hear Jim's arguments means that McDermott will be paying Boehner something in the neighborhood of $1 million, money that McDermott doesn't have.

Does this guy own any homes or condos? If he owns one in Washington I would bet it’s worth that..........start digging....perhaps Ron Goldman’s dad would have some useful advice. ;^)

I didn't believe the explanation when it happened, that is that two folks happened to overhear a cell phone conversation and record it in their car. A more likely explanation is that an illegal tap was on Newt's land line phone and they couldn't admit it.

I'm not technical enough to know how that is done.

Real estate in the parts of DC,MD and VA where Congresscritters tend to live are most assuredly not cheap. Given that McLeaker’s been a Congresscritter for some time I can’t see him having been renting all this time.Boehner should get his lawyer to search the Registry of Deeds for DC and nearby counties in MD and VA.I’m sure they’ll come up with something.

When a civil judgment exceeds one’s ability to pay, one simply declares bankruptcy and moves on with one’s life. I don’t see why he won’t be able to do precisely that.

McLeaker's website says he's served nine terms in the House.Today,Congresscritters make something like $150K/yr and they've always been well paid.And it seems highly unlikely that his House salary is his only income.Speeches....books...who knows what else he might have been making.With all this income for all those years I can't imagine him not owning some real estate...hell,I make much less than him and *I* own real estate.

Also,I don't think you can discharge fines/judgments levied by courts through bankruptcy.

This is a developing story. Among the two largest contributors to Baghdad Jim’s legal defense fund last year were Jim Sinegal, of Costco, and one (note that there are two in the area)William Gates.

I never bought the idea that the elderly couple actually recorded the conversation. I think the Democrats had an active surveillance going on Gingrich - and those two dupes were “cut outs”. I saw the news conference on C-SPAN with the two “activists” and their conversation, in discussing the happenstance capture of this call was totally devoid of any technical language to describe the details (type of scanner, frequencies scanned, taping mechanism/equipment, etc.). It didn’t pass the smell test. We all know scanner geeks and they cannot talk about their hobby without littering the description with jargon. These two geezers couldn’t convey that they know how to turn it on much less scan the right frequencies for cell calls.

That said - many thanks to Rep. Boehner for his dogged pursuit of McDermott - this case was at the SCOTUS 3x. It took a lot of $ and a lot of dedication to see this through.

Right. The story about the Martins is simply not believable. A couple is riding down the road, happen to tune in a phone conversation between two Congressman, and then happen to have, and then decide, to tape record the conversation in the car while riding down the road. Then, they decided to give it to Jim McDermott. Too many coincidences to be believable.

I have shown (at least to my satisfaction) that the story is impossible scientifically.

Based on their statements, they recorded for over 1/2 hour while driving on a freeway in Miami at 45MPH+. During that time, they would have HAD TO HAVE LOST ONE CELL TOWER AND SWITCHED TO ANOTHER ON A DIFFERENT FREQUENCY! How could their cheapie Radio Shack scanner (illegally modified to allow reception of cell frequencies) know what frequency to switch to?

Can’t answer but I believe it was a hard tap by McDermott himself and given to the couple for their story. Remember, they received a slap on the wrist for a felony carrying a prison term and $10,000 fine.

There is probably not a story on this.

I was in business doing radio work, mobile telephones and that sort of thing for 45 years.

I am familiar with developemnts in those fields. There was a big fight over the wiretap issues before the FCC.

There was a federal law passed that required wiretap capability. In paging companies, the provider has to provide the pager address code so a duplicate pager can be used to record all paging transmissions.

All cellular switches (the central office) must provide a wiretap port so selected phones can be recorded.

There are too many signals (thousands) for a scanner to be able to track and record a particular phone.

During the Clinton administration they had Echelon, which is a computer program that could monitor all this, including internet.

What is most unbelievable about it to me is that a cell phone uses two frequencies, not one - it's a fully duplex device. They just happened to be scanning both frequencies? Simultaneously?

It hardly matters anyway - passing on wiretapped information such as this is a felony and McDermott voted in favor of the bill that made it so. These folks got off with a small fine and a collective chuckle in the media - yeah, we finally got Newt. These are the same people who pretend to be horrified at Bush's tapping of terrorist phones. Go figure.
