Police say Horn shot 2 men in the back

Two men suspected of burglarizing a neighbor's home were shot in the back by Pasadena homeowner Joe Horn after the suspects ventured into his front yard, Pasadena police disclosed Friday.

Also, for the first time, investigators revealed the Nov. 14 shooting was witnessed by a plainclothes Pasadena detective, who had pulled up in an unmarked car seconds before Horn fired three shots from his 12-guage shotgun.

The detective's name was not released as the new details emerged about the controversial shootings that have outraged minority activists but also brought an outpouring of support from others.

“In Texas it is legal to shoot someone engaged in criminal mischief after dark.”

That’s a good law, but this incident took place in the early afternoon, around 2PM.

The law allows for the use of deadly force against criminal mischief in the night, but burglary at any time.

It was theft in the daytime, breaking and entering, but not robbery or burglary.

Dude, what do you think "burglary" is? Theft is taking something off someone's porch. Breaking and entering is breaking into some secured place but leaving empty-handed or getting caught in the act. Burglary is breaking in and taking something away. This was burglary plain and simple. They had the loot on them, $2000 cash in a white bag, when they were shot.

Well, I 'll have to check to see what the Texas statute for burglary says: at common law, burglary is breaking into and entering of the dwelling house of another, at night, with the intent (at the time of the entering) to commit a felony therein. This didn't happen at night.

From the Texas Penal Code:

§ 30.02. BURGLARY.
(a) A person commits an offense if, without the effective consent of the owner, the person:
(1) enters a habitation, or a building (or any portion of a building) not then open to the public, with intent to commit a felony, theft, or an assault; or
(2) remains concealed, with intent to commit a felony, theft, or an assault, in a building or habitation; or
(3) enters a building or habitation and commits or attempts to commit a felony, theft, or an assault.
(b) For purposes of this section, "enter" means to intrude:
(1) any part of the body; or
(2) any physical object connected with the body.
(c) Except as provided in Subsection (d), an offense under this section is a:
(1) state jail felony if committed in a building other than a habitation; or
(2) felony of the second degree if committed in a habitation.
(d) An offense under this section is a felony of the first degree if:
(1) the premises are a habitation; and
(2) any party to the offense entered the habitation with intent to commit a felony other than felony theft or committed or attempted to commit a felony other than felony theft.

Yeah, premeditated alright -- a premeditated defense of his neighbor's property in accordance with Texas criminal law.

See posts 110 and 139. Although there is debate as to the exact time, it appears that the shooting occurred in the early afternoon.

So, if I'm reading you correctly, breaking and entering is not burglary? Even if you take something? I recall that property from the house was found on the corpses.

OK, I give up; hang Mr. Horn for doing a public service!

The “shot in the back” is a red herring. You can be advancing towards me, I raise my weapon to defend myself and,at the last mili-second, you twist your body around to avoid being shot—voila the “shot in the back”—doubtless what happened here.
The plainclothes officer “witness” is likely a total fabrication. Senior police officials and Houston politicians have clearly decided to lynch Horn to appease the Quannel Xs of the region. They knew their case was weak—so they fabricate a witness. Nothing new here —cops perjure themselves every day. If there was a Houston cop there, why he he not intervene? This will not fool a jury of decent honest Texans.

I think the saddest part to all this is that Mr. Horn had to be in the position to clean up the job that the Federal, State, & local LEOs failed to do.
If they were illegal immigrants, previously deported, prior criminal records, and in the act of carrying out another crime, the entire law enforcement community failed and Mr. Horn stepped up to protect his property and the community’s.
The real issue is that the paid protectors failed Mr. Horn and the neighbor completely and as a responsible citizen, Mr. Horn performed perfectly. Unfortunately it has to happen this way now.
I congratulate Mr. Horn on performing his civic duty and acting according to his God given right to remain secure in his home & community day or night. The real crime here is the failure of the LE community and our complete acceptance that citizens have to rely on 911 for protection.

He called 911 3 times trying to get the police to show up...police are linking one of the dead to many more robberies...This would not have happened if the police would’ve shown up in a timely manner. And what was that detective sitting in his car...why didn’t he take on those two thieves? Poor Joe Horn...

It won’t matter. He shot them in the back which clearly indicates that they were not threatening him.

"Officer, They threatened me by actions and words and I feared for my life, and shot when I did because I did not want them to find cover and resume their unlawful activity. Now I want a lawyer".

The guy is a hero in my book, however in today's society, he might just be sacrificed to the PC gawds. If there is a defense fund, I'll contribute. Americans are tired of being preyed upon by recidivist criminals and invaded by illegals.

I think they are illegals from Columbia but at first they said they were from Puerto Rico. They look black.

Dude, that's cruel and unusual punishment!

I say we sentence him to 5 days on the range....I mean he shot 3 times, wasting a valuable shotgun shell, which is much, much more valuable than criminal illegal aliens, IMHO.

Really...I could’ve shown they looked like two black men, isn’t that why X was struttin’ around with the black panthers...two black brothers, yuk. Now, one of the criminals wife was on tv...boy, now she and her son are both definitely black.

In a reasonable society, we would be allowed to shoot home intruders in whatever part of their body we wanted to. It should be considered a risk inherent in the act of burglary.

OK...I had not heard that...the tv coverage is not saying that. The wife of one of the dead criminals was on tv the same day her husband was killed...boy, was she playing to the tv news crew...crying...you could see dollar signs in those tears.

Sounds like the authorities are going to try and crucify him.

I'm sure they are aware that any such move would be massively unpopular. It would also raise the question of why an "undercover cop" is sitting outside not making his presence known in a situation where the 911 dispatcher knows full well that the presence of uniformed police would defuse the situation in progress.

I am never certain as to just what the PTB are aware of.

I agree that it will be hugely unpopular.The level of disgust with our government is rather high already without them pulling some hamfisted move against what most people think is a regular guy, forced to fend for himself against a tide of invaders and an indifferent (at best) government.

My take on the audio was that the cop on the phone was just trying to keep the guy from defending himself and the neighbors until the crimaliens got away clean, again. He was almost taunting Horn.

If the cops won’t do their jobs, the citizens will, and with far less niceties.

It’s still too early in the game, but a few more of these incidents could awaken the sheeple in a manner the PTB will find quite uncomfortable.
