Gary Solis, a former Marine Corps attorney and a military law professor, said the service appears to be taking a very aggressive stance against Nelson.

“I know of no other case except Haditha where individuals have been charged with misconduct in the course of battle,” Solis said.

Someone is bound and determined to cut their pound of flesh from the Corps, by hook or by crook.

WAR IS HELL

Especially when the lawyers get involved.

William Shakespeare (Henry VI Part 2):

Dick:
"The first thing we do, let's kill all the lawyers."

Jack Cade:
"Nay, that I mean to do. Is not this a lamentable thing,
that of the skin of an innocent lamb should be made parchment?
that parchment, being scribbled o'er, should undo a man?"

He is being prosecuted in civilian court because he is no longer in the Marine Corps and was not subject to recall to service.

How does a civilian court claim enough jurisdiction to bring charges like this? He wasn't on a tropical island, lying on the beach, and committed a prosecutable act. How does the local judiciary claim jurisdiction over the military acting oversees?

Any first year law student knows, "no autopsy, no case." GWB needs to send the Haditha Marines home for the holidays...along with Compean & Ramos.

It seems that the Democrats have totally infiltrated our military structure.

I am an old man who volunteered during the Vietnam era. If I was a kid now I wouldn't!

I guess Murtha is rolling over in his grave with laughter … wait, he isn’t dead yet, my bad. ;-)

“While the rules of engagement were loosened during the battle, the law of armed conflict governing military behavior forbids the shooting of any enemy combatant who has been disarmed and does not pose a threat.”

That law is a bit more severe than laws regarding citizen LEO’s. Police routinely shoot suspects in this country and it is all justified by the prosecutors...

“That charge alleges he failed to follow the rules of engagement and the laws of war regarding the handling of detained prisoners of war.”

Why does the prosecutor care. Its not like he let them escape or something truly tragic.
