How about “opening” a bar that is entirely outside...then you could build a small enclosure for the non-smokers.
How about cutting a hole in the roof? Screen in an area and allow smoking under the outside sky.
There of course will be times that it don’t work too well, but gotta fight these nannies.

In New York state an outside designated smoking area cannot legally even have a roof or walls to protect smokers from the elements.
That is beyond the scope of “protecting” non-smokers - it is mean spirited and calculated to make smokers as uncomfortable as possible.
Most places upstate ignore the law.
I am a non-smoker but disagree with nanny state laws like this. Tobacco is a legal product and people should be free to use it in reasonable ways.
I hope I live long enough to participate in the next revolution to overthrow tyranny as predicted and advocated by Thomas Jefferson and other Founding Fathers.

They tried to make porches for smokers in Ohio, but the law said that if it had 3 sides it was "enclosed" and therefore the Nazis forbade it.
