That is ridiculous ! Here in Colorado Springs, there is one bar that built a "temp" structure for the smokers to use. I am a non-smoker and prefer to go into a place where I don't walk out smelling like a chimney but there is also the issue of the business owners rights to run his business as he see fits. The "temp" structure is one hell of a good compromise. Smokers have a place to go and be protected from the elements and at the same time, I can walk in and leave without smelling like smoke.
n New York state an outside designated smoking area cannot legally even have a roof or walls to protect smokers from the elements. That is beyond the scope of protecting non-smokers - it is mean spirited and calculated to make smokers as uncomfortable as possible. Most places upstate ignore the law.
