Probably no failed process!

The lawyers decided to go after the weakest link to show damage to their client; then they escalate up the chain of deepest pockets, to get into the real money.

The deceased family will probably wind up with the $1 million; the schmuck lawyers will probably turn it into a class action suit for all the “pain and suffering” that thousands of commuters had to endure in traversing the tunnels. Then they will pocket $100 million, while sending out $2.00 checks to the class action participants.

The report doesn't question the design, the report questions the Construction,Construction management, and QA/QC.

Had Gannett Fleming, Inc., in the construction contract for the D Street portal finishes, specified the use of adhesive anchors with adequate creep resistance, a different anchor adhesive could have been chosen, and the accident might have been prevented.

The Specification was inadequate among other deficiencies listed. Sure the load calculation was ok, but that was only part of the engineering.

Gannett Fleming, Inc., and Bechtel/Parsons Brinckerhoff failed to account for the fact that polymer adhesives are susceptible to deformation (creep) under sustained load, with the result that they made no provision for ensuring the long-term, safe
