SSgt Wuterich to be first Haditha Marine on trial

The court martial for SSgt Frank Wuterich, USMC, has been scheduled for March 3-14, Defend Our Marines has learned.
The court martial for a second enlisted man, LCpl Stephen Tatum, is scheduled to commence March 28. The battalion commander, LtCol Jeffrey Chessani, will go on trial on April 28. A fourth court martial, for Lt Andrew Grayson, has not yet been scheduled.
Before SSgt Wuterich's trial commences, there will be two sessions for arguments on motions on February 13-15, 2008, and then on February 20-22, 2008.
Attorney Mark Zaid says, "We expect a very lively pre-trial environment as several very important issues will be raised that could dramatically impact the charges that go forward."

I wonder if they will try to get the Iraqi depositions thrown out since they refuse to come to the US to testify. Also, since their were no autopsies, how can the prosecution definitively charge SSGT Wuterich with any manslaughter charges? They have no proof that he killed any Iraqis.

Trying to get details. It may be very well be along the lines you suggest.
In the Sharratt case, though, it was Iraqi witness statements that helped clear him.

When SGT Wuterich is proved innocent (which SHOULD be the assumption in the FIRST PLACE) I hope he sues John Murtha for every last penny he can squeeze out of his fat hide.

Thanks so very much for posting this. We certainly could use all the financial support we can get! This is going to make those lawyers bills and related expenses go sky-high. Every penny donated goes directly to Frank’s defense fund. We appreciate everything that is being done and pray that in the end his INNOCENCE will prevail.

All we can do is prayerfully hope the defense lawyers for these Marines shall make it clear they had to do what they did within their ROE, and recommendations for all charges to be dropped be the end result.
