Given the wave of Republican retirement and resignation from the Congress the high probability is that Congress will be solidly Democrat after November. Even if the Republican president appoints solid Constitutionalists to the Court, the result will be liberals on the bench because the Senate will not confirm good judges and the president will then send up second or third choices chosen for their ability to be confirmed. If Giuliani would promise to leave seats vacant rather than appoint judges that the Senate will approve, then I might support him. No Republican candidate could stand to leave a seat vacant. They all seem to think that the Court must have nine Justices. That is not supported n the Constitution. There can be any number of USSC Justices. There can be three or there can be a hundred.
Now that would be interesting.
