I think I said this on another thread, but a retired Marine lieutenant colonel sent me a message recently.
In his view, this whole fiasco is the result of a conflict between the combat and admin chains of command. And the admin side is dangerously in charge.
I'm not familiar with the particulars of the UCMJ, but I know that videotaped de bene esse depositions sometimes are used at trial when a witness will not or cannot be present. In my experience, it's been to obtain expert witness testimony -- I suppose it reduces expenses.
The deposition is similar to examination in trial, with direct and cross-examination. Objections are later ruled on by the trier of fact before presentation to a jury, and the questions and answers to which objections have been sustained are edited out.
