Anthony Kennedy, who authored the Kelo decision which gutted the Fifth Amendment, was appointed by Reagan. David Souter, who concurred, was appointed by Bush I. Sandra Day O'Connor, appointed by Reagan, wrote the decision which upheld the gutting of the First Amendment by McCain-Feingold, as well as decisions in Grutter, which upheld the University of Michigan's racist admission practices; BSA v. Dale, which prohibited the Boy Scouts from barring gay scout leaders.
Is the aggregate of the decisions made by Dem appointed judges that much superior? Have they handed down superior decisions over the last 50 years? Did they make decisions that supported the constitution better than the Republican appointed Justices over time?
