Lawmaker: Illegal Immigrants' Cars Should Be Seized[Georgia]
CBS 46 ^ | 13 Feb 2008 | CBS 46

ATLANTA -- Immigrant groups are pouncing on a bill that’s gaining steam at the state Capitol to allow the seizure of cars belonging to illegal immigrants.

On any given day in Georgia, thousands of illegal immigrants are driving on the roadways, many of them uninsured.

State Rep. James Mills said he wants to make all illegal immigrants think twice before getting behind the wheel.

“The front door and the back door of our nation has been kicked in,” Mills said. “It's time that we secure the house in Georgia.”

Mills’ bill would allow law enforcement officers to confiscate someone’s vehicle if that person cannot prove he or she is in the United States legally.

That would apply to illegal immigrants involved in car wrecks and those who have been pulled over for minor traffic violations.

Sarah Katz is a policy analyst for the Mexican American Legal Defense and Education Fund. She wants to know how legal immigrants will be able to prove they’re legal on the side of the road.

“There's no ID that says I'm a U.S. citizen,” Katz said. “Even myself, I don't carry around my birth certificate. My driver's license is not an indicator of my legal status.”

“Georgia Legislature is out of control and they need to make sure that they reign in some of these xenophobic, racist legislators that are targeting the immigrant community specifically for these reasons,” said Jerry Gonzales, executive director of the Georgia Association of Latino Elected Officials.

Mills said he stands by his legislation.

“They broke the law to get here,” Mills said. “They're breaking the law by driving on our roads with no driver's license. They're breaking the law by driving on our roads with no insurance. Our law abiding citizens are footing the bill.”

Under this bill, proceeds from the sale of confiscated cars will either go to the legal citizens injured in the crashes or the local government in which the car was pulled over on a traffic stop.

The bill is expected to have some intense debate when it comes up in a house committee early next week.

I think you just got the bill passed.

No driver’s license, no car. Isn’t that the way it’s supposed to work?

Only if you’re a U.S. citizen.

An illegal immigrant couldn’t get a Georgia driver’s license (not legally anyway), but there are 8 or so other states where they can legally get one.

I’m not a big fan of asset forfeiture without serious due process... I’ll have to think this one over...

This could be the next step for Arizona and Oklahoma.

I was on jury duty the week of 12/11/06 and one of my fellow jurors told me that her nephew was killed a year earlier by two illegals DRIVING their truck with FAULTY BRAKES to the BRAKE SHOP to be repaired when – surprise, surprise — the BRAKES FAILED AND THEY KILLED HER NEPHEW. I guess these MORONS thought they were back in Mexico where – in addition to driving DRUNK — they and their idiot friends do crap like that all the time. Can you say “Tijuana Taxi?” Can you say “TOW TRUCK?”

The driver got 4 years in prison and will be deported when he gets out.

Gotta wonder how long it will take him to sneak back in and kill someone else?
Estimates indicate they are killing around 25 American citizens each day, either with vehicles or via other criminal activity.

I can’t wait until the interstates start filling up with Mexican truckers on tight deadlines – and I do mean DEADlines – hurtling at carloads of unsuspecting native-born American citizens – all 387 of us.

Do you suppose this crap might stop if one of Bush’s daughters became a victim?

Of course, unlike the rest of us, they are driven to their endless round of parties by an armed SS detail, which eliminates the risk that they will be tempted to drive drunk themselves or be mugged or raped.

If their here illegally, then they should not have a license. If they have no license, then their driving breaking the law. Their also driving on tax payer roads illegally. I am all for the seizure, provided proof can be obtained post haste that they are illegal.

Every effort should be made to make it as hard as possible for an illegal to do ANYTHING in this country. Those efforts are already on the books too, as far as I am concerned. Problem is the "amnesty" types that are in our government from the local to the federal. The illegal should not be able to even register that car. Hence, it's on the road illegally.

Yeah...well think fast....these are NOT US CITIZENS for whom “asset forfeiture without serious due process” applies....kinda like a bank robber who’s decided to run a red light.....they got caught!

Please, can you tell me where you found that statistic? I’ve seen it posted here frequently before at FR, but no refernced source and I haven’t been able to find the source.

So your hypothetical bank robber who ran the hypothetical red light should not get due process either?

I'm seriously unhappy about illegal immigration and all of the problems that it brings with it, but my reaction to the proposed legislation is that it may have been drafted a bit too hastily. Since when are Republicans in favor of government confiscation of property?

Do you really think that, if such a law were enacted, the government could resist the temptation to expand the situations where it would be used? The legislature can white-out the "only applies to illegal aliens" wording of such a law faster than you can say "Montezuma's Revenge".

Imagine this - a traffic photo camera detects that you went through a red light or exceeded the speed limit. The next day (or maybe even in the next few minutes), you don't get a ticket or a summons to a court hearing handed to you or in the mail, rather, a police department tow truck hooks up your car and takes it away - for good. After all, we don't need no stinkin' due-process.

It's not farfetched at all - the Feds (and some cities, such as NYC) are doing things that are close enough to that scenario that it should frighten anyone...

Do you suppose this crap might stop if one of Bush’s daughters became a victim?

Reminds me of the Liberal comment:

"eligible children of the extended Bush family, including the twins, serve in George's "noble war for a noble cause" or Bush must bring the sons and daughters of America home now."

In some states, your vehicle tag can be seized and your car impounded for driving without insurance. Choose those you sent to Washington from your state. I am not a southern border state so don't ask me to pay for what your state and local governance should enact and enforce. I have issues in my state unrelated to illegal immigration that need fixing and will not request it be fixed on a federal level.

If the Bush daughters had the choice of living in a fishbowl with constant Secret Service protection vs. just hanging with friends whenever they liked, guess which they would choose? They both have grown up a lot since their rocky start, after their dad became President. Jenna Bush is current traveling the country promoting her new Harper Teen book, Ana's Story

In this age of fostering pure hate toward Bush and the war, with talk show hosts like Bill Maher saying Cheney should have been assassinated, they become prime targets for terrorists and/or wackos tuning in, who get off on Bush Bang shows like Maher's. Incidentally, one daughter was robbed in Argentina.

I would suggest you try to focus your anger productively, without attacking the Bush twins in parallel cause and effect analogy. I do not think you really mean what you have written in their regard.

Where it all began:

Estimates indicate they are killing around 25 American citizens each day,..”

On 630 KHOW-AM's The Peter Boyles Show, guest William Gheen said:

Boyles guest acknowledges "no one really knows how many Americans per day are being killed by aliens and illegal aliens":

GHEEN: Well anyway, they're all up in arms because I came on your show, and I said that according to Congressman Steve King's office in Iowa, that at least 25 Americans per day were being killed by illegal aliens. Come to find out that the study and whatnot, it was killed by aliens or immigrants, non-U.S. citizens, at least 25. It wasn't specifically illegal aliens, although the truth of the matter is that no one really knows how many Americans per day are being killed by aliens and illegal aliens. Everything is an estimate. So, because I said 25 when the actual number is over 12 or between 12 and 25, instead of 25, they've jumped up in the air screaming that, "Look, look. Here's an example that William Gheen is untrustworthy, and Peter Boyles is disseminating terrible propaganda to the nation." The bottom line to it is that -- what's important is that far too many Americans are being killed and injured today by illegal aliens that aren't supposed to be here in the first place, that our system can remove and prevent many of these crimes.

Reminds me of Dan Rather being caught (Buckhead) up in the false Kinko memo scandal and still contends to this day, it is accurate.

An illegal was driving the car of his brother’s boss (said he brother lent it to him, but he didn’t have a driver’s license, Virginia). He was drinking something coming down a winding road and crossed into the parking lane, totally my car which I had given my daughter.

She was 6 months pregnant then and would have been killed, along with the baby, if she had been in the parked car. Her husband filmed the guy trying to pull his embedded truck out of my car. He lied to the police about what happened, but my son-in-law showed the police the film and he was cited/ticketed on numerous offenses.

Needless to say he disappeared.Fortunately insurance covered the loss of the car but I spent hundreds of dollars trying to sue others involved in the event but lost on a technicality (not complaining).

Other illegals have made my street a target zone for drunk driving, hitting about 12-14 cars within a 6 month period.

Some were caught and jailed. The others got away with it.

It is time for a change in the law.

“There's no ID that says I'm a U.S. citizen,” Katz said. “Even myself, I don't carry around my birth certificate. My driver's license is not an indicator of my legal status.”

Lack of a license should be.

“Georgia Legislature is out of control and they need to make sure that they reign in some of these xenophobic, racist legislators that are targeting the immigrant community specifically for these reasons,” said Jerry Gonzales, executive director of the Georgia Association of Latino Elected Officials.

He wouldn't say that if most illegals were blue eyed, blond haired Germans. He only cares about overrunning our country with people dumb enough to give him more power.

They are not. Getting closer to the root of the problem, we need a fence, and we need to stop letting Muslims in by the gross if we are to stop our servants, the government, from taking away our liberty in the name of “security”.

We keep voting for “front runner” candidates, who will do nothing.

See my tagline, for the definition of “front runner”

This is a reasonable law that would help prevent criminals from accessing our roadways with illegally acquired equipment. Sounds pretty good, and it will absolutely make them think twice about breaking the law in Georgia. Provided the law is very specific on applying the confiscation to vehicles “owned” by the aliens.
