If the Catholic Priest fiasco is any guide shouldnt this school district be sued into oblivion? Well, in fairness, no. The church hide and protected pedophile priests, moved them from parish to parish and obstructed criminal investigations. The actions of the church were so egregious as to transcend mere negligence or even passively condoning, they all but encourage the priests' behavior. Not at all comparable.
An employer is only responsible for actions of his employee that can be reasonably be construed as consistent with the employers policies or wishes, or if the employer fails to supervise the employee. Clearly the teacher was acting outside of her professional duties and against school district policies.
