GRAND RAPIDS -- A 63rd District Court employee claims Rockford District Judge Steven Servaas sat in such a way that exposed his jockstrap at a 2007 court staff Christmas party, according to testimony introduced Friday by the Judicial Tenure Commission's prosecutor.
The surprise allegation by Detroit-based Commission Director Paul Fischer, who is seeking to remove Servaas from the bench, had Servaas' defense attorney James Brady seeing red during the opening day of testimony in the state's case against the judge.
"It's a slime-ball tactic," Brady said.
Rebecca Andrus was the first witness to testify in the Kent County Circuit Court room. She said during a November retirement party, Servaas made demeaning comments about her chest size.
After seeing Andrus in a University of Michigan sweatshirt, Servaas said her breast size would be more appropriate for a smaller school, such as Alma College, Andrus testified.
"He said, 'Well, I better move on before I get in trouble or get sued,'" said Andrus, who works for chief 63rd District Judge Sara Smolenski in the court's Grand Rapids Township branch.
"I was devastated. I felt very shaken, and I felt the tears when I realized everyone was staring at me," she said.
Fischer then asked Andrus about an incident at the Dec. 21 staff Christmas party where Servaas allegedly arrived in very short racquetball shorts.
Brady objected, and it was noted the incident never was mentioned by Fischer in any filings, and he never indicated he intended to question anyone about it, according to retired Judge Casper Grathwohl, who is acting as the special master in the hearing.
Brady argued it would be "a tragedy" to have the allegations aired, but Servaas loudly declared he didn't care if they talked about it.
So Andrus was allowed to testify about the matter in a separate record that can be preserved in case of appeal, but would not be considered by the judge in deciding this case.
According to Andrus, Servaas exposed his jockstrap strap and was told at one point to either cross his legs or cover up with a blanket. She said more than 35 people saw the alleged exposure.
Andrus testified that at the same party she was walking by Servaas when he grabbed her arms and tried to restrain her, and she had to struggle to get free.
Andrus said she never filed a complaint but did keep a written record that included documentation of a 2002 incident in which Servaas disciplined her while she worked briefly in his Rockford court.
She said the 2002 incident, in which Servaas banned her from the Rockford court, did not color her decision to testify against the judge now.
Fischer said he did not plan to air the allegations of the alleged exposure but did so because Brady's opening statement said the judge never engaged in conduct of this type.
Servaas, 62, is facing a potential suspension and banishment from the bench where he has served for 35 years for allegedly vacating his seat by moving to an Ada Township address.
Servaas also is accused of making remarks to Andrus that could be construed as sexual harassment, and drawing male genitalia on a sticky note attached to a court file.
Brady said he is ready to stipulate Servaas did not live in the Rockford court's jurisdiction for a couple of years, but lived in an Ada house, which still is within the 63rd District Court's reach. Brady argued in opening statements Servaas never made a secret of his Ada home and even was listed in the phone book.
Brady said there is no evidence Servaas doodled female breasts and another drawing showing "a finger or penis." He has a list of 28 witnesses, many of whom are prepared to testify to the good character of the judge.
Fischer objected to the inclusion of any character witnesses, but Grathwohl agreed to let four testify when the hearing resumes next week.
For his part, Fischer contends the whole case comes down to one character trait on the part of the judge.
"The Greeks had a word for it," Fischer said during his opening statement. "Hubris."

It is a nonpartisian elected position.
I don’t know which way he leans. But he has been elected and re-elected for many, many years in a very conservative part of Michigan.
Not so many years ago that asinine remark would have earned the judge a slap across the face for being rude to a lady.
Now days we sue for the slightest "offense"
