I know where this is going. There are many here who love to make fun of police officers. Let me ask the bad assess who talk big on this forum a question. If you were a police officer on duty walking your beat one night, how for would you let a stranger come up to you with a rifle or shot gun in his hands without drawing your weapon? Well, I'm waiting. Who's going to be the first one to admit his’s a dumb-ass?

The problem is that you are changing the situation.
It was daytime. The pistol was holstered, not in his hands. He was not making any threatening moves.
Certainly not a threat and not warranting felony stop type actions.
