17-Year-Old's Parents Signed Consent Form for Their Daughter to Marry Her 27-Year-Old Teacher

A 27-year-old teacher in Texas has been arrested after he applied for a marriage license with his underage student, even though her parents gave consent. Cases of teachers trying to marry their students are on the rise.

Randy Arias taught Spanish and coached track at the Austin high school where 17-year-old Brenda Guerra was enrolled.

Police say that the pair secretly started dating one month ago and that they learned of the relationship from an anonymous caller.

"Whoever did call made a good judgment call," said Lt. Eric Mendez from the Austin Independent School District. "They met on the weekends and from there it just kind of blossomed."

According to court documents, "Arias asked her to the movies around the first weekend in March 2008 and then took her back to his apartment where they had sexual intercourse."

Police say even though the affair was consensual, Arias was arrested and now faces up to 20 years behind bars. In Texas any sexual relationship between a teacher and a student at the same school is a second-degree felony.

Neither Arias nor Guerra have spoken out, but her mother, who gave her blessing with her signature, told The Associated Press the reason was "for love."

More than 2,500 educators were punished for sexual misconduct between 2001 and 2005, according to an AP investigation.

I can understand guilty of violating school policy but it is an odd law. She is above age of consent in this state.

There was an 18 year old who got a teacher arrested over similar deal last year.

And this teacher was going through the motions of marriage (doesn’t sound like he was sneaking around her parents).

Mom says good riddance. Troublesome teenager is the teacher’s problem now...and then the authorities wreck everything.

since teacher-student sexual activity is being reported more and more which would make it seem almost epidemic, just out of curiousity has anyone ever heard a comment on this from the national education association ?

it would certainly be interesting to know if they are the least bit concerned about this immoral, unethical, and alleged criminal behavior by so many of their members.

Here is the relevant Texas statute.

A little chastity before marriage, and these two would be home free.....

Somehow I doubt police officer is job restricted for sexual encounters with the public.

Slow news day.

Yeah, teachers hitting on the kids has become so common. I'm surprised anyone pays attention.

Let me get this straight. In Texas, it’s legal for a 27 year old to marry a 17 year old, if the 17 year old’s parents give consent, but it’s a felony (punishable by up to 20 years in prison), if the 27 year old is a school teacher?

I’d say the laws in Texas need a little reconciling.

Why would anybody allow their child to attend a public school?

“I’d say the laws in Texas need a little reconciling.”

He was arrested for having sex with his student prior to their wedding. From this story he seems like a good candidate to benefit from prosecutorial discretion.

P.S., note the totally inaccurate headline.

He was arrested for having sex with his student prior to their wedding.

I missed that part. Was it in the story? I did see that they had been dating for a month. Your explanation certainly makes more sense.

That was easy, so was she.

even though her parents gave consent.

This makes it seem a lot less of a crime to me.

this must have been a real tough story. it took FOUR people to write it.

And still they got it wrong. The girl was not "underage" (17 in Texas)

The issue is the teacher-student relationship.

"In Texas any sexual relationship between a teacher and a student at the same school is a second-degree felony."

In the article - it clearly states she went to the perp's school and they had sex on their first date...

She's a slut in addition to jail bait - and he's the fool.

That's an oh oh! -- 2nd degree felony...

He could have married her BEFORE having sex with her - with no problem...
But he got horny too soon -- she was jail bait by virtue of being a student in HIS school and therefore "untouchable"...BEFORE marriage.

The law DOES draw a distinction between dating or married students.

21.12. IMPROPER RELATIONSHIP BETWEEN EDUCATOR AND
STUDENT. (a) An employee of a public or private primary or secondary school commits an offense if the employee engages in:
(1) sexual contact, sexual intercourse, or deviate sexual intercourse with a person who is enrolled in a public or private primary or secondary school at which the employee works and who is not the employee’s spouse; or

However, her name was not to be released to the media:

(d) The name of a person who is enrolled in a public or private primary or secondary school and involved in an improper relationship with an educator as provided by Subsection (a) may not be released to the public and is not public information under Chapter 552, Government Code.
