Another case for discussion might be the lawsuit decided in favor of the woman who refused to wash her hands [yes at all] while working at McDonald's in Vancouver. She claimed it irritated her hands. The whacky court in Canada has no problem in allowing a person to use the restroom, NOT wash their hands, and then return to food preparation duties! Yuck!

I think this only applies to that particular lawsuit, but I'm not going to eat in Canada anytime soon.
In a previous ruling, they also said a restaurant can't fire someone with communicable diseases, in this case Hepatitis.
