They are public property and their use can be conditioned howsoever the government desires...like the use of a public forest or park or the funds of the Federal Reserve.

Prior to the Communications Act of 1934, the airwaves were being treated just as land is. Those who claim it and use it first, are entitled to it.

The idea of the airwaves being Volkseigentum is a socialistic New Deal notion.
