Here it is again since you missed it the first time, and the second time. Perhaps you will actually LOOK at it the third time and comment upon it.

Martello v. Martello - Dad gets 40% time with his kids. BUT .... $9,000/month gross income (before taxes) .... $5,600/month spousal support .... $2,800/month child support .... $862/month net income and FICA, State and Federal taxes not included yet. By the way - Estimated taxes are $2,600/month for his income level by the state.

Does this man have a problem with his priorities or did a judge just try to MURDER him?

If the state can pauperize a high income dad like this, then there is something SERIOUSLY wrong with the law.

This kind of debate always emerges between people who consider their self-interests first; especially when mixed with personal feelings about the bastard or bitch on the other side. One thing I can point out is your observation (and mine and many others including some chapters of NOW) that the enforcement system isn't very effective. It's not supposed to be. It's not designed to do anything useful. It's a pork-barrel program.

States maximize their income to themselves from the federal program by enrolling as many as possible, even if that involves setting cs orders too high to pay. Everything paid through the system is labeled "collections" even when they come from people who have the same kind of payment record that you did. Since 1990, cs award levels have been arbitrarily high, set by formulae that are not based on needs and ability to pay - they're just arbitrarily high. State income is based on the total amount "collected" (i.e. paid) through the system.

It's a statistical fact that the vast majority of non- or late payment is caused by the payer's inability to pay what has been ordered. This is exacerbated by arbitrarily high awards to begin with and the refusal of courts in almost all cases to grant downward modifications when circumstances warrant. Federal law - note federal when constitutionally this is not a federal issue - provides states with the ability to set awards according to "potential income" rather than actual income - i.e. another way to keep arbitrarily high amounts on the books for collections.

Well ... I'm probably going on too long for your interest ... which seems more directed at getting the bastard your daughter married ... so I'll cut to the chase. You're getting screwed as a taxpayer. You're experiencing lots of extra emotional grief by getting frustrated when the guy doesn't meet arbitrary demands set by the courts, this distorts and amplifies your daughters feelings about getting a bad deal and what a bad guy he turned out to be .. making her situation more personally destructive, and if I went on longer with my explanation, I'd get to the point of how all this corruption destroyed marriage and individual rights that you probably still think you have.

Regardless of all the feelings you have about how other non-custodial parents these days must be made of far worse stuff than yourself, supporting the corrupt political agenda is not to your benefit. And BTW: I've studied this stuff for years - and I'm well prepared to assert that NCPs are not as bad as propaganda in support of the government's program has led people to believe - they're typically regular guys who are being abused for the sake of government corruption - i.e. just like you but under different circumstances. Of course, your guy is much worse than all the rest - obviously (he's Canadian).
