WASHINGTON, May 18 (UPI) -- The Texas Border Coalition, which includes a number of cities along the U.S.-Mexico border has filed a lawsuit against the border fence.
In court papers filed Friday in Washington, the group asked a court to block the construction of the fence in the Rio Grande Valley.
The coalition, which also includes business groups, charges that the Department of Homeland Security did not consult landowners in the area. DHS Secretary Michael Chertoff denied that in a news conference Friday.
Eagle Pass Mayor Chad Foster, who chairs the coalition, called the fence "an antiquated solution for a 21st century problem."

I know a family NW of Big Bend that owns land right up to the river...
Now if there is a “buffer” zone, I have not really heard about it...It would be kinda like an “easement” of sorts...I have one on two sides of my property here, that I have to maintain (mow, edge etc etc) one is a pipeline or utility easement, and the other is a “right of way” raod easement...

But as far as I know, you can be sued for anything, by anyone, at anytime...Its just how far it goes in the system that may be where the “stopper” is...

The answer is both. As far as I know in most places property owners own the land right to the border. There is a strip here in NM that is a government right of way that was originally set up to protect the border (might have been part of the issue of contagious cattle disease many years ago) this strip is controlled by the Dept. of Interior and they have delegated the authority to the BLM. Interesting thing is that a few months ago the BLM would not allow the Border Patrol to make a road right on the border- due to their concern about the environmental damage. Insanity rules when it comes to the border- so many, including our own government see no need to secure the border. It simply amazes me.
The biggest landowner on the border here- denied access to the fence survey crew about a month ago and the survey crew left, expecting a long court battle before they could return. I don’t know what happened but the survey crew was back at work last week. I guess the landowner’s attorney must have felt it was futile to try to stop them in light of that decision.

The specific names of the leaders of this group need to be publicized, along with info on the specific properties. How can one protest a namelss “group?”

Texas is somewhat unique in land ownership in that the Feds basically owned no land in Texas when Texas entered the Union. The land was owned by the state or individuals up to the border, etc. Since then of course the Feds have purchased or acquired land in Texas. But a lot of the land along the border is still private or state/county/city owned up to the border line on the US side.
From home land security and that includes what has been built prior to the fence bill, and take away the 22 miles of 2 foot levee in hildago county. Not much to build there, LOL, "The great republican fence scam goes on"

Appalling but by no means surprising.
As you parse through each assertion in the article it becomes clear that almost NONE of the fence has actually been built (except what small amount the Guard did in 2006).
By comparison, the Alaska Pipeline took 2 years for planning and permitting; 3 years for building the actual 700 miles of pipeline (through a much more punishing climate than the US/Mexico border); and $28 billion in 2006-adjusted dollars ($40 million per mile).
I do recall that the Pipeline was the subject of regular news reporting in the 70’s due to its mammoth scope under harsh conditions. You don;t see too much of that with our illusory “border fence”.

I still believe that fence will never be built until they’ve mucked it up so bad they have to keep the US slaves from escaping!
Where is the border not “the border”? Was this country not surveyed many years ago, and do not surveyors mark the territory? Can the border belong to a single entity, or does the border belong to “the people”, and can borderland fused by an individual be taken for eminent domain? Borders carry security responsibilities to a country - at least they used to. Put up the damned fence!
