Posted: 3:05 PM- SAN ANGELO, Texas - The Texas Supreme Court today turned down the state's request to overturn an lower court's ruling that that hundreds of FLDS children have been taken into state custody improperly. The high court's ruling comes a week after the Third Court of Appeals ruled that some, if not all, of the more than 450 children in state custody should be returned home to the Fundamentalist Church of Jesus Christ of Latter Day Saints' ranch in West Texas. The children were taken into state custody during an early April raid on the YFZ Ranch, based on the state's contention that all were at risk of sexual and physical abuse due to the sect's practice of polygamy. The children are in foster care or shelters scattered about the state. Those 12 months and younger can have their nursing mothers with them, and some have been reunited with their families but remain in the state's care. The raid was authorized by 51st District Judge Barbara Walther in San Angelo, who also ruled after two days of hearings that the children should remain in custody. The appeals court found last week that Walther lacked sufficient evidence to support the state's claims that all of the FLDS children were at risk. |

Same as before. And the State has the added benefit of the evidence seized in the initial raids. That wasn’t ordered returned, AFAIK.
My whole beef was the kangaroo style court Walther ran. It was as much an abomination as what Warren Jeffs did.

P.S. - Most of the LEOs were on perimeter secuirty duty and there were no tanks.

And you seem more than willing to spread a lot of it around yourself. Well, now the kids are back with their abusers. Little 10 year olds can be married off to old geezers, and life goes on for those of us fortunate enough not to live in such hellholes. Hope you’re happy.

I doubt they will prevent them from doing anything. But it will depend on what the ruling actually says. There might be restrictions, there might not be.
The free exercise of religion does not allow for human sacrifice or any other action that infringes on the God-given inalienable rights.

Heck it was your 'understanding' that your 'expert' was right and the 3rd Circuit and the Supreme Court of Texas are all wrong.
I wouldn't bet too heavily on your 'understanding' of anything right now.
And no, I'm not 'happy' about anything having to do with this clusterf***. The State of Texas really humped the bunk here, and they're going to pay very dearly for it.
So unless and until you have some factual information to impart to us I would think you'd want to keep your 'understandings' to yourself.

Yes, you ARE happy, so don’t pretend you’re not. You see nothing wrong with what they do to those children there.
As to where I “understood” there was a criminal case, it was in a news article. The article stated that no matter how the custody case went, the criminal case(s) would move ahead.

I could find no restrictions there doing a quick read. A matter of some concern.
Yes, hopefully, the attorneys for the minor children will have some influence.
If, as you say, the attorney for the Bradshaw-Jessop kids was concerned when she/he heard testimony from Dan and his wife, she/he should have been. What I read is that Ms. Bradshaw was incredibly vague.
Do you know if that attorney is Natalie Malonis (spelling?)?
I saw Malonis on TV last night, saying that she would have problems with the kids being returned.
That being said, I still believe that CPS has acted illegally, and that Judge Walther abused her discretion, by taking ALL the kids with no evidence that all were in imminent danger of physical or sexual abuse.
Everyone on this board thinks that the children have rights. What people are saying is that Texas, in the rush to help the children, has trampled on the legitimate rights of the parents. Yes, the children need help. Unfortunately, Texas has created a mess that will hinder the efforts to help the children.
We'll just have to wait and see how this all works out, but I do sincerely hope that these children are better off when this is all over. I also hope that we don't lose some of our rights in the process.
