STATE OF OKLAHOMA 2nd Session of the 51st Legislature (2008) HOUSE JOINT RESOLUTION 1089 By: Key AS INTRODUCED A Joint Resolution claiming sovereignty under the Tenth Amendment to the Constitution of the United States over certain powers; serving notice to the federal government to cease and desist certain mandates; and directing distribution. WHEREAS, the Tenth Amendment to the Constitution of the United States reads as follows: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."; and WHEREAS, the Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and WHEREAS, the scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and

WHEREAS, today, in 2008, the states are demonstrably treated as agents of the federal government; and WHEREAS, many federal mandates are directly in violation of the Tenth Amendment to the Constitution of the United States; and WHEREAS, the United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states; and WHEREAS, a number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States. NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE 2ND SESSION OF THE 51ST OKLAHOMA LEGISLATURE: THAT the State of Oklahoma hereby claims sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States. THAT this serve as Notice and Demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers. THAT a copy of this resolution be distributed to the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives, the Speaker

of the House and the President of the Senate of each state's legislature of the United States of America, and each member of the Oklahoma Congressional Delegation.

Ok...I did a search and couldn't find this here. I can't believe it hasn't been posted so maybe search is down or "oklahoma" doesn't bring the correct result.

In any case somebody help me out here. It appears this went down in March, but I haven't heard a thing about it. Maybe I've had my face screwed into a sewer drain?

I want some of that!

Hopefully, this will start a trend. There are several areas where the Federal Government has completly failed.

Securing our borders, enforcing our immigration laws, protecting us from attack from terrorists, keeping our Armed Forces ready, supplied, and funded.

I’m sure Oklahoma feels justified. I just wish the border states would follow. And that includes my home state Texas.

Just my two cents.

A very interesting prospect. At the founding of this nation, states held effectively more power than the federal government. But, almost from the beginning, the struggle for power between the federal government and states for-shadowed the loss to the states we now have today.

Jefferson and others knew it would inevitably occur and the states would play second fiddle to the federal government. It will take much education and another great awakening before Americans reclaim their country. This, while encouraging will likely not happen in my lifetime but it is my hope it does before it is too late.

I’m from Oklahoma (in Tennessee right now) and hadn’t heard anything about this. I’ll certainly find out though and report back. My Dad knows people in OK State Government.

Every citizen of this country interested in the type of Federal Government that we have should read the Kentucky Resolutions and the Virginia Resolution. They were written by Jefferson and Madison. They were aimed at limiting the Federal Government’s powers over sovereign states. In a nutshell, the Federal Government is the agent of the states. The states formed the Federal Government and the states have all powers not explicitly given to the Federal Government by the Constitution. Uncle Sam appears not to be able to read and interpret our Constitution.

ALL the states are sovereign states. The federal government would not exist if the sovereign states didn’t create it and delegate certain enumerated powers to it, while rataining ALL the other powers for themselves or the citizens of those states.

Good for Oklahoma that almost all their reps understand it.

Hardly a declaration of war. More like reminding the federal government of their limited powers and that they derive their limited powers form what the states grant them.

I don't really see what all the fuss is about.

Oklahoma is simply declaring they have powers under the Constitution and demanding that the Feds not exercise powers not granted them under the Constitution. Basically, it's just another toothless symbolic resolution.

Don't get me wrong, I am all in favor of the states standing up against Federal encroachment. I just don't expect anyone to start firing on Ft. Sill anytime soon.

Federalism fed the 9 pound chimp and turned it into a 900 pound gorilla. Still don’t mean the gorilla is right.

And frankly I don’t care if the gorilla is pissed off or not. The gorilla needs to start going on a damn diet. Maybe this is the first step. It would be the best way to deal with spiraling debt and deficits. Only allow it to do the few things it is supposed to do and get it the hell out of everything else it shouldn’t be doing.

I’m totally in agreement, I think the fedgov should be pared down to bare bones and the states re-empowered.

If McCain is president, they'll get support from him - he is adamant on State's Rights FIRST...per the Constitution.

If the states did this, it will be the best and surest way to defeat the Marxists/Communists. They would be done for - they must have control from Washington to succeed. Without that, they are done for.

We can only hope Oklahoma pushes this and has the other states follow suit. The federal government has become way to involved in our lives and needs to be reeled back in.

Florida should pass this resolution ASAP to stop the Commie Cuban/Chinese from stealing its oil in the waters between Key West and Havana. Florida maintains that it has a 120 mile off shore oil drilling zone. With the Cubans and Chi-Comms drilling only 60 miles from Key West that rig falls within the 120 exclusionary zone and should be shut down or taken over.
It is time for Governor Crist to show that he has something more than a good tan, and that he is a leader.

Wouldn’t get too excited folks; this was introduced into the Oklahoma House on MARCH 13th. It got referred to the Senate Rules Committee upon passage, where it’s been since March 25th.
