(ID Supreme) Court Rules Illegal Immigrants Are Residents

BOISE--The Idaho Supreme Court ruled Monday that an undocumented immigrant who was injured while living in Ada County is entitled to medical indigency assistance from the county.

A majority of the justices sided with Saint Alphonsus Regional Medical Center, which had sued the Ada County Board of commissioners after it denied an application for medical indigency assistance from Javier Ortega Sandoval.

Sandoval had more than $187,000 in medical bills after he had a stroke while working in the Boise region.

The high court found that undocumented alien status doesn't affect the determination of whether someone is a resident. In other words, the concept of residency doesn't distinguish between citizens and those who entered the country illegally.

The ruling could have widespread impact. Some Idaho countries already provide emergency medical indigency assistance to illegal immigrants, but many do not, and hospitals cannot turn away emergency patients because of their inability to pay. That means hospitals may not be paid for the care.

Yeow! Everyone needs access to emergency care, but after reading the entire article, this ruling sounds wrong, just plain wrong.

There's something wrong in this country when illegals get free medical care but Americans have to pay for them as well as for their own health care.

The solution is to create a different entity that people who can pay for medical care go to and that does not qualify as being a "hospital." Basically, this is the "non-emergency room" hospital. Or the doc in a box.

Residency now trumps citizenship.

Kiss your hospitals goodbye. This was the start of it in California.

Once the illegals know about this (and they will), then they will come in unprecedented numbers. Welfare attracts clients.

Actually it does. Idaho code specifically states "A resident does not include a person who comes into this state for temporary purposes, including, but not limited to, education, vacation, or seasonal labor."

Problem being in this case is the undocumented worker fell into the "but not limited to" clause and was awarded tax payer paid medical.

I suggest voting the judge out (we can do that in Idaho) and getting on the horn to your local reps to have this section of Idaho Code rewritten to not be so "vague" on illegal aliens. I put vague in quotes because I think it's pretty clear what the intent was.

Everyone needs access to food as well. But imagine the disaster if anyone could legally go to any resturaunt and demand any food for free.

This ruling is preverted. I would like to see a close investigation of these judges, notably their bank accounts. Blackmail, bribery, or plain “hate America”?

Ergo, Arizona's Prop 200. We specifically spell out that welfare benefits are not available to illegal aliens (residents).

Emergency medical care is one thing, but your illegal status actually has meaning here in AZ.

People who live in ID need to start taking action against this kind of judicial tyranny. Increasingly we are sliding into a krytocrazy - rule by judges. Numerous cases of violent repeat pedophiles have been set free by judges and judges have blatantly broken their oath of office and the law.

First step might be to gather information about the personal and professional lives of these judges and publicize their corrupt decisions by letters to the editor, talk radio, emails to politicians, picketing, the Internet, etc. Bill O'Reilly has shown that media pressure can at times lead to results.

These rogue judges need to be removed, and there should be safeguards from demented decisions.

Illegal aliens should not even be in this country, certainly not entitled to perks. Even though I do not live in ID, I would like to help with efforts to remove these judges.

Ok, not trying to start a flame war but some points:

1) Courts have consistently defined the term of art “resident” to mean nothing more that residing in a particular place, regardless of citizenship status. This is not a controversy.

2) The Idaho Supreme court interpreted the meaning of the term in the context of the law on the books. Nothing more. Judicial activisim would have been to hold that the term “resident” means something new in this instance. The court did not do this.

3) The legislature of Idaho can change the law to require legal citizenship or residency. The legislature shouldn’t abdicate its responsibility to govern, in hopes that a court will bail them out on a controversial issue. The legislature, needs to do it’s da*n job on this issue.

4) That is all. Flame me.
