Dad grounds daughter, but court ungrounds her

A court has overturned a father's penalty for his daughter for disobeying his orders to avoid the Internet – the cancellation of a school trip, according to a new report.

According to Agence France-Presse, Justice Suzanne Tessier in Quebec Superior Court ordered the grounding for the 12-year-old girl lifted, prompting the father's lawyer, Kim Beaudoin, to warn, "Parents are going to be walking on egg shells from now on."

The father had ordered the daughter, who was not identified by the report, to remain off the Internet. She didn't, chatting on websites her father had tried to block and then posting "inappropriate" pictures of herself online, using a friend's Internet portal.

As punishment, the father refused to let her go on a scheduled school trip, so the 12-year-old went to Canada's judicial system to get her way. Beaudoin told AFP the punishment was for her own protection and is pursuing an appeal.

Thankfully, this is a story from French Canada, not the US.

Any kid (or grandkid) of mine who went to court over a non-abusive punishment such as grounding would immediately find that their college fund had just become my personal “toys” (computers, software, guns, etc...) fund.

posting "inappropriate" pictures of herself online

I'll bet the judge was upset because he was looking at those pics and wanted her to keep it up.

The father, who is appealing the decision, was “devastated” by the ruling, Beaudoin said. He is refusing to take his daughter back “because he has no authority over her.”

The judge decided the punishment was “just too much”? Okay, the first question in my mind is, “WHO THE **** DOES THIS SANCTIMONIOUS **** THINK SHE IS?” And right behind that is, “is anyone planning to make this judge the most miserable meddling **** in the province?”

Whether such a story originates in USA or CAN makes little difference as we’ve also seen this sort of meddling in the States. Our overlords will keep this nonsense up until someone puts the fear of God into them.

Aha. :)

That prompted the girl, with her mother's support, to take legal action against her father, culminating in Friday's ruling.

Thanks for the link.

Looks like the father had custody, the girl left to live with mommy, and with her mother's support sued dad. The judge took the fact that the girl had moved in with her mother into consideration.

One wonders...
- Is this judge a rabid feminist?
- Is this judge divorced?

I smell a man-hater.

Silly you.

At 18, she’ll just go back to the same court and sue you to cover the costs of her education.

How do you think that court will rule?

When I lived in California, my neighbor handled the judge as follows:

Brought the daughter and a suitcase to court, and when the time came he announced to the judge; “Your Honor, since the court has deprived me of all parental authority, she’s all yours!”

And he managed to exit the court before the judge was able to collect herself and charge him with contempt.

(I’ve always wanted to be charged with contempt, just so I could tell the judge just how guilty I was of the contempt charge.)

According the attorney for the kid, strong action was needed because of the "rite of passage" nature of this particular trip. Here's a quote from Lucie Fortin, the insubordinate brat's lawyer:

"...for me that was really important, because it was the end of elementary school, it was the end of a stage in her life."

Sadly for the kid, it might be the start of another stage in her life, a stage of life where she can post inappropriate pictures on the computer for any creepy pervert on the prowl who happens by, a stage of self-destutructive freedom where the indulgence of a lax mother with issues is apparently backed up by lunacy from the courts.

Link to story with more on the angle of the girl:

"It's a very different situation than a child who might appear to not be happy with the parent's decision and simply say, 'I'm going to go to court and I'm going to get what I want,' " she said. "And if in fact it's been portrayed that way, it's not putting it in its complex context." While the girl's father has full legal custody, pending a further court decision, the girl has been living with her mother, Ms. Fortin said.

There is no complex context. The father had custody, and the judge should have sent the girl back to the father. Case closed. Instead, the mother now has a little girl who expects the courts to side with her any time she wants to behave in a manner that responsible adults consider inappropriate for her age. I hope she still thinks getting back at the father was worth it when she's the target of this little girl's next court case.

I've never liked anything about this book, despite the people who consider it a classic, but mother and daughter need to read it together. It wouldn't surprise me if it foreshadows their future issues.

Mother and daughter are headed for trouble as a team. I hope one day the girl will grow up to appreciate what her dad was trying to do for her.

Question: If the father had full custody, most certainly, that was granted in a court, yes?

Wouldn’t the judge that gave him custody look down on another judge stepping on his decreed rights as the legal custodian of the child?

Logic aside, what in the world is the matter with the nit-wit that sided with the 12 year old??! What’s next? Emancipation for 12 year olds??
