Inaction in boy's killing called justified
San Francisco Chronicle ^ | 6/19/08 | Demian Bulwa

(06-17) 19:07 PDT TURLOCK (STANISLAUS COUNTY) -- The town of Turlock and much of the rest of the nation was shocked when a 27-year-old man beat and stomped his 2-year-old son to death on a rural road. But what was nearly as stunning for many people was that none of the motorists and their passengers who stopped and saw the attack tried to tackle the man.

(snip)

A volunteer firefighter and at least five others saw Sergio Casian Aguiar assaulting his son Saturday night on the road west of Turlock (Stanislaus County), but it wasn't until a police officer arrived in a helicopter that the attack finally ended.

(snip)

Darley said he was also not surprised that people who weren't at the scene of the killing believe they would have been heroic Good Samaritans.

"It's an aspiration," he said. "They hope they would have done differently."

(snip)

"We were looking for rocks or boards on the ground, just to knock him out, get him under control. But we couldn't find anything," McKain said. "We didn't know if he had a knife or any kind of weapon on him."

Since this is California, they will talk around this for days and days without anybody saying the obvious. If one of these "bystanders" had been armed and been practiced in the use of his weapon, this attack would have ended right there.

Either that, or we have to institute a 10-day waiting period for a pair of boots and close the Shoe Show Loophole...

So, anybody know why this man killed his kid? Majority of parents, after all, don’t do this kind of thing.

"We didn't know if he had a knife or any kind of weapon on him."

A man was beating a baby to death, and they didn't interfere because they didn't know if he was armed?

According to the article, he was shouting something about the child being possessed by demons. Of course, the assailant is dead now, so nobody can ask him.

Sounds like the guy was a nutbar.

But who cares about motivation? Is there a motivation that would be sufficiently rational to justify inaction? Is there any possible scenario where a two-year-old “had it coming”?

The initial reports I read had eyewitnesses talking about their futile efforts to wrestle the guy into submission but that he just shook them off.

I'm not gonna take that bet...

Of course, this article is in the SF Chronicle, so don't expect the newspaper to tell you the answer to the obvious question.

It sounds like those initial reports may have been incorrect.

Yup. That's what it says.

Get used to it. It's gonna get worse before it gets better.

At least the video is not out on YouTube (yet...)

I believe it’s an unwritten law in CA that people are not to interfere with another person’s drug-induced rage.

I guess their vehicle did not have a tire iron.

Ya’ know.....one guy engages the man while another snatches the kid to safety.....

You don’t have to win the fight, they just had to distract him for a few moments....

This reminds me of the video of the elderly man hit by the car in Connecticut.....There are no excuses for anyone standing by and watching a baby being beat to death.

My 110lb wife would have waded in on that one....

The inaction is disgusting....These people every night for the rest of their lives should see this baby in their dreams screaming and writhering in pain calling for help.

I’ve got to go puke now.....

At some level, yes, there is a shock. But it's that "too shocked to react" part which needs to be looked at and into. No one had a tire iron in their car? Was everyone afraid of being sued? Have people become too accustomed to the Nanny state "we pay taxes for people to deal with this?" Too many stories of psychotics suing heroes?

Yes. All of the above.

Yes, had one of these been armed, maybe things would have turned out differently.

Years ago, Safeway grocery parking lot. I get out the car, walk, a man is beating the crap out of a woman. I yell at him to STOP. He doesn't. I'm getting closer to him, yelling and demanding for him to stop, calling him names. He does stop, turns his focus on me, begins verbally threatening me. The woman scrambles and runs like heck to safety inside the store.

Store calls police, etc. while man and I are screaming at each other.

I've found various sprays to be very useful when I've encountered ugly situations like the one above. And always, yes, my heart was pounding like crazy, and my fear was very high; but my desire to help was greater.

Those who say that we cannot judge those who weren't there are mistaken. We can, and we do, and we must.

People had cars, they had things in those cars which they could have used. A heavy purse is also useful.

From article: Over the next seven minutes, McKain said, Aguiar kicked his son at least 100 times as he calmly stated that he needed to "get the demons out" of the boy.

"It was like I was on some type of drug or something," McKain recalled Tuesday. "I couldn't believe what was going on. It was like a dream."

So, witnesses observed the above. They've bought themselves a lifetime of sorrow through their inaction. They witnessed the toddler being kicked at least 100 times, and did nothing. The criminal was calmly stating he needed to "get the demons out" of the boy, key word being "calmly". And they stared. Did nothing.

God knows how many people were murdered by Saddam Hussein's hidious regime. And the left said we should simply stay OUT of the affairs of another country.

Were they mesmerized by the violence, too?

Dear Lord.

This little boy is in His arms, now. And those who observed this and did nothing are rightfully in purgatory. The killer will probably be excused of his crime.

The Sheep Look Up.

How the hell can anyone NOT intervene? Even if he had a weapon I would have launched into a flying tackle or something.I’ll bet noone even yelled at him either. California has way to many pu$$ies who are afraid to do anything risky. Risking my life to save a child would be something I wouldn’t even have to second guess.

My vehicles have those short little tire irons with the light metal extension rods. Not exactly the best weapon.

of course thats why I carry a gun.

socialism teaches people they can’t help themselves and must wait for the govt representatives. I think we’ll see more of this as this country goes more socialist.

I read another article on this story stating the child was unrecognizable and they had to use DNA to prove his identity.

Yes, but that tire iron is still useful. I'd always kept a tire-thumper in my car for exactly such purposes; until the state (CA) passed a law outlawing tire-thumpers. My kid's old baseball bat became a permanent installation in my car; always with an old mitt nearby for my CYA statement should one be required. Then of course, there's some nifty new "flashlights" which can give one a horrid headache should one look directly into its light.

Yes, I'll say it: SHAME ON THOSE SO-CALLED ADULTS WHO DID NOTHING TO HELP OR SAVE THIS LITTLE BOY.

Is it possible, these adults have been beat down long ago by the anti-freedom legal promiscuities of the Democrats of CA? And now, there's little left in them which resembles adults?

In Canada they would have all been speed dialling Ottawa and screaming *Do Something!*

I do believe that in the minds of many passive, nannified people of today, they are afraid of being sued, and lets face it, they just do not care that much about strangers. There was a video available for awhile of a woman whose wheelchair tipped over at a busy street corner in Toronto, and unseeing zombie wireheads with their iPods cranked up to Eleven or their BlackBinkies jammed in their ears stepped around her and walked on. Finally a woman across the street rushed to her aid and only when she started screaming at the passing zombie males to help her did a couple guys come out of their media-induced Personal Planet and even dial 911.

I believe it has a lot to do with the indifference people feel toward strangers. I have had men make snarky comments to me when I am standing on the subway and they are sitting, such as *I guess you think I should give you my seat just because you are a woman.* I always ask them in a polite voice, *What if my son was speaking that way right now to your mother?* Suddenly, for some of them, I stop being some nameless Representative Of A Class and become a human being. I honestly believe for people who drift by or stand passively staring at tragedy, that they do not relate to strangers as individual human beings.
