Rove ignores committee's subpoena, refuses to testify

Karl Rove, President Bush's longtime political guru, refused to obey an order to testify before a House Judiciary Committee hearing Thursday.

Rove's lawyer asserted that Rove was "immune" from the subpoena the committee had issued, arguing that the committee could not compel him to testify due to "executive privilege."

The panel is investigating allegations that Rove and his White House allies dismissed U.S. attorneys and prosecuted officials who they saw as political opponents.

The panel subpoenaed Rove in May after his lawyer, Robert D. Luskin, made clear the former White House deputy chief of staff would not appear voluntarily.

Luskin responded immediately that Rove still would not appear, prompting a threat of prosecution from the Judiciary Committee chairman, Rep. John Conyers, a Michigan Democrat, and Rep. Linda Sanchez, a California Democrat who chairs the subcommittee on commercial and administrative law.

"A refusal to appear in violation of the subpoena could subject Mr. Rove to contempt proceedings, including statutory contempt under federal law and proceedings under the inherent contempt authority of the House of Representatives," Conyers and Sanchez wrote.

"We are unaware of any proper legal basis for Mr. Rove's refusal to even appear today as required by the subpoena," Sanchez said Thursday morning when Rove failed to show up. "The courts have made clear that no one -- not even the president -- is immune from compulsory process. That is what the Supreme Court rules in U.S. v. Nixon and Clinton v. Jones."

In May, Conyers contrasted Rove's refusal to testify before Congress with his paid work as a commentator for the Fox News Channel and Newsweek magazine.

Can you imagine how this Congress will act with a "president" Obama in the White House? I see "war crimes trials" for the entire Bush administration and leading GOP figures, as well as "show trial" for Global Warming "deniers", "corporate bigwigs" and capitalists.

Nothing’s going to change until federal marshalls march on Congress and uphold their pledge to defend us “against all enemies, foreign and domestic”.

The arrogance is so bald and unflinching because they get away with it. No mention that clinton fired the entire lot US Attorneys when they came into power.

Someone posted than when the communists take over a Nation the population goes down a third. I o not think that we will be an exception to this.

The thing is, from what I see now is that most people in America will be too stupid to realize what is happening or the role they played in bring it about. They will blame it on Bush.

If shame meant anything in the US the leaders would resign and take back bench seats. I think the public is finally onto the "Bush's fault" routine, probably because of the quieting in Iraq.

Also, in a normal world where people are held accouintible, neither Reid or Pelosi would be re-elected after they idiotically promised two years ago to lower gas prices.

While I'm on a roll, how does someone stay with OB after he drastically changed his "get out now position" on Iraq? Take about bait and switch.

I never used to think this way.

But since the Senate failed to do their duty and convict Bill Clinton in 1999 and Gore tired to steal the election in 2000,there has been a foreshadowing of things to come for anyone who has eyes to see.

We have been spared what has happened to many other countries by God’s grace for a very long time.

We are on a collision course where the American people will be forced to decide if a governnment of the people, by the people, and for the people will indeed perish from the face of the earth.

If it happens I predict it starts with a mutiny in the armed forces against their hopelessly incompetent and fiercely anti-American commander-in-chief. Everytime McCain throws another advisor under the bus, it feeds my belief that a revolution is not mere conjecture but a fait accompli. I think we should cheer it because we could not survive Democrat control over all branches of government.

If he intended to take the 5th he could have done that. What he is doing, and what many liberal journalists and commentators are too incredibly %$#@&^* dense to recognize, is pointing out that the White House, and specifically the President, has asserted Executive Privilege. The 5th amendment privilege is one personal to anyone who faces criminal penalty and wishes to avoid testifying so as to avoid making the case against them self. Karl does not have the choice to make the call n Executive Privilege - it must be made by the President, he made the call and now the Congress needs to go to court and make their case that Executive Privilege does not cover such matters. Good luck finding the answer before about 2011.

I smell a double standard that doesn't just include the fact that Democrats routinely hire and fire people based on political affiliation or resistance and opposition to their agenda.

They want that. The news shows and Obama campaign ads (and hey, how do you tell the difference?) would run the video of that every hour as proof of Bush's criminality.

And it wouldn't stop them from issuing new subpoenas for any and all other charges they could invent, no doubt down to the heinous pulling the tag off the mattress crime.

The 5th Amendment is a two-way street, even though it's been forgotten imo and modern jurisprudence doesn't seem to treat it that way..

Take "Scooter" Libby for example: in today's climate of "perjury traps" wouldn't Libby have been better off to assert his 5th Amendment rights not to have testified at all? Say nothing even to the point of having his attorney invoke the right?

Input from FR lawyers and AALs (Almost A Lawyer, as they say in the bar rooms) needed?
