Editorial: Assessment ruling won't serve state well

Monday's state Supreme Court decision striking down an assessment by the Santa Clara Valley Open Space Authority was one more nail in the coffin of California's quality of life.

Not that the court was unreasonable. The justices were interpreting Proposition 218, as convoluted and mean-spirited an anti-tax law as California voters ever passed. The 1996 initiative aimed to tighten the rules set by Proposition 13 to make it even harder for government to raise revenue, and it's succeeding all too well.

Californians must come to grips with the kind of place they want to live in, and whether they're willing to pay for it. The parks, trails, libraries and other public facilities people value did not come free and won't come cheap in the future. If we want these things, we need to get serious about tax reform. Not tax prevention, but tax reform.

The open space assessment struck down Monday had been upheld by an appeals court, but it always seemed like a stretch. Preserving open land clearly improves the livability of the region, which improves property values - but not exclusively for properties within the district. Without that narrow and direct benefit, the court said, a levy has to be a tax and go to a public vote.

I live in San Jose....
The “Murky News” has served a very small percentage of this city — the leaches, illegal immigrants and civil servants.

The Murky News has been sinking faster than the Titanic — nearing bottom...

It’s been a joy to watch the death of this Leftist rag.

The leftist newspaper claims the “public” values any spending program, but opposes any effort to let the public actually express that support via the ballot box.

Leftists don’t like democracy, because sometimes people don’t vote the leftist way.

The quality of life in CA is about to go to hell, but not for the reasons the author cites. It’s precisely because of the policies the author supports that people like me are and will flee this state. I think it’s going to look like a very different place in five to ten years, and it’s not going to be pretty.

I was in Ohio during the great company exodus in the 70’s. The lib solution? Fine the companies that wanted to leave. No kidding. The idiocy of liberals defies description.

Liberals want to raise taxes - and yes - taxes that have nothing to do with property related services. Two years ago liberals tried to impose a first ever statewide parcel tax that was thrashed soundly at the polls. But they're not giving up on the notion you should pay more. They hate the provisions of the California Constitution that limits how much they can take out of homeowners wallets without their approval. No wonder they're up in arms.
